NEC is ON!

This updated list shows GreenShift with three Reps at the NEC - which is happening now.  What a great time for the judge to come out with his supplemental Markman ruling.  This should maximize  buzz in the industry.

Interesting to note that ICM has increased its attendees AFTER the latest "good" news from the courts. This solidifies the belief held by many that DVG, ICM and the infringers are not going to roll over and settle. As I have repeatedly stated this is going to be a hard and long slog through all the legal machinations until money changes hands and we can buy our way out the debt albatross around our necks. Just more data to support this thesis.

I need to add one more comment to your slanderous statement. Since last June I have gone out of my way to reassure folks that I was convinced that GERS' principals were not crooks or conducting some nefarious shell game. I was convinced that they are well-meaning, hard working, legitimate business men caught up in a drama (the litigation) that they cannot control. I made this public assessment after face-face meetings, that had this assessment as the goal. To state what you have is literally slanderous and serves no useful purpose to your fellow GERSlanders but to attempt to assassinate my character at their expense. This reality paints you as a very devious person. By, the way, you can believe what I believe about the principals and still question certain activities; these are not in conflict as you think.

There is a lot that doesn't add up and why there is much mystery and quandary about what really is going on with our company, our licensees, and potential clients. Why aren't the other ethanol producers beating a path to our door so that they can make more money? Why do we have to litigate our way as opposed to marketing our way to success? Why is there such a discrepancy between what should be a very transparent translation of licensee revenue to our revenue? Why is dilution not only continuing but appears to be increasing when KK stated that he thought it would end in 2012? Why was such a small dent in the YAGI debt made even though $1.6 million was pledged (and not satisfied). Why is it so hard to find alternative financing if the future is so bright? Why is the very positive litigation news not generating any interest in buying GERS common stock, in fact the PPS has fallen since that PR? If we can answer these questions we can make informed decisions about our future.

LAS VEGAS (DTN) -- The theme for the 2013 National Biodiesel Conference this week is "momentum" -- a word that largely has been foreign to a U.S. biodiesel industry that has experienced seemingly endless fits and starts in recent decades.

Speaking Tuesday to hundreds of biodiesel producers and others at the biodiesel board's conference, Chief Executive Officer Joe Jobe said he believes 2013 will feature the best of times for an industry that has seen its share of ups and downs.

"We get to do a little bit of celebrating," he said.

"A precedent is set to set a pathway for industry growth for the next 10 years. The next 10 years is an era of exciting growth. The last 10 years is like our teenage years -- very high highs, very low lows."

Jobe said biodiesel has played a role in a rural renaissance fueled by higher commodity prices from the expansion of biofuels.

Unless Washington pulls the rug out the biodiesel industry has a lot going.

The industry started the year with the renewal of the all-important $1-per-gallon biodiesel-production credit. The EPA recently set the Renewable Fuels Standard for biodiesel at 1.28 billion gallons in 2013 -- meaning the industry that has created a market for soybeans and other oilseed crops is poised for growth. In 2012 the U.S. biodiesel industry churned out 1.1 billion gallons.

"The upside to all of that struggle is that we as an industry are seasoned and battle tested," Jobe said.

"This will be the most prosperous year for the industry. The system is becoming more refined as we go along."

"There is a small segment of the petrol industry that wants to misrepresent us," Jobe said.

"We are putting you on notice right here today. Ten years from now people will be held accountable for the truth. A decade from now history will show who were the champs and who were the chumps."

WASHINGTON TALK

Weston J. Coulam, an attorney with Washington-based Ernst and Young, said any biodiesel industry hopes of a longer-term extension of the biodiesel tax credit would depend on a divided federal government.

Talk of tax reform, he said, will make it difficult to succeed with individual legislation aimed at such an extension.

"As long as tax reform is still out there they will not want to address individual bills including tax extenders," Coulam said.

In addition, if there is a move in Congress to repeal the Renewable Fuels Standard, Coulam said it would be debated in the broader context of larger energy legislation and not as an individual bill.

"And it's unclear how the 2014 (mid-term) election plays into that," he said.

"It's hard for me to see the House and Senate to have one big bill they can agree on."
Ginny Terzano, a public relations expert with the Dewey Square Group in Washington and former press secretary to Vice President Al Gore, said President Barack Obama's renewed talk about climate change since the November election could bode well for the biodiesel industry.

ACE responds to API, says oil industry is grasping at straws regarding E15


The Senior Vice President for the American Coalition for Ethanol (ACE), Ron Lamberty today blasted the American Petroleum Institute (API) for the oil groups’ latest attack on E15 fuel.

Lamberty says the latest interpretations from API on the Coordinating Research Council (CRC) test results should not scare consumers away from using E15.

“This is just another ghost story, told by people who stand to lose market share when consumers finally have access to E15. We shouldn’t be surprised at Big Oil’s latest attempt to scare consumers - they’ve shown no shame in twisting test results to protect their market share. There is a reason that the oil companies don’t want E15 and it has everything to do with protecting the bottom line and nothing to do with protecting consumers.” Lamberty said.

“Today’s press conference did, however, prove what API and Big Oil are really trying to protect. They showed their true motives when they used this unscientific study as some sort of “proof” that the Renewable Fuel Standard (RFS) should be repealed. Ethanol is gaining a larger share of a shrinking U.S. gasoline market, and Big Oil will stop at nothing to protect their huge profits,” said Lamberty. “The idea of farmers and ethanol producers taking more market share via E15 is what truly haunts the oil industry. Big Oil’s refusal to comply with the RFS isn’t proof the RFS doesn’t work - it’s proof they don’t want it to work, because they don’t want to compete for consumers’ fuel dollars.”

AUTO CENTRAL - January 29, 2013: This morning, the American Petroleum Institute held their latest telephone press conference in their continuous attempt to undermine any alternative fuel solutions and keep us addicted to gasoline.


The information released by the API today during the press conference added nothing new or significant in their fallacious assault on ethanol…except one thing. The two presenters took on the surprisingly conciliatory pretense of “having nothing against ethanol.” They went so far as to say that there are fine “blending qualities”about ethanol.


They just don’t want it living in their neighborhood, so to speak.


API did what they have done for decades: they made up lies and insinuations, and they mischaracterized ethanol. To listen to them, anyone would think that vehicles that run on gasoline never experience any engine breakdowns or system failures, and that fuel pumps, fuel lines, pistons and cylinder walls only ever show signs of wear if alcohol somehow gets into the fuel system. They warned about consumers experiencing roadside breakdowns and costly repairs because of E15 use. What? Are they suggesting that the millions of vehicles that have broken down over the past 100-years only broke down because they used fuel other than gasoline?

To use the old phrase made contemporary again by Joe Biden: The API is full of malarkey.


The API guys stated, yet again, that the EPA prematurely approved the use of E15 in vehicles manufactured since 2001. API says that there hasn’t been sufficient study. They conveniently ignore the fact that alcohol/ethanol has been used in vehicle engines since the mid-1850’s; that virtually every independent study of gasoline vs. ethanol shows ethanol is the superior engine fuel; and that even the automobile industry’s top scientists (including the General Motors guys who invented leaded gasoline) believed that ethanol is the better fuel. They also ignore the fact that there are other countries on this planet that have relied on ethanol and various ethanol-gasoline blends for years, with no problems other than those that are customarily experienced by internal combustion engines.


In addition, they gloss over the fact that the government’s testing laboratories didn’t just take up the study of ethanol as an engine fuel in the past couple of years; they have studied ethanol and different blend levels for many, many years. Moreover, Ricardo Laboratories– the world’s leading and most respected private lab dealing with fuel issues – did its own study that shows that E15 can be used in all vehicles going back to the early 1990’s.


They have also mischaracterized, again, the EPA’s E15 waiver; making it sound like it wasn’t just a recommendation, but that it is a mandated imperial order. They referred to a recent AAA warning about E15 causing engine damage as if AAA conducted their own conclusive testing of the fuel. But AAA didn’t, they relied on the lies given to them by the oil lobby and then invented some of their own gross exaggerations to make the warning seem more urgent. It’s just more malarkey; hot stinky grotesque batches of malarkey.


But perhaps the single stupidest misstatement that the two presenters made today is when they characterized ethanol as being dangerously corrosive. Let me remind everyone that ethanol is alcohol. Alcohol can be consumed; it can be rubbed on your body; it is used to clean and disinfect sensitive medical instruments that are used on internal organs of the human body; and you can leave an open container of alcohol in a closed room without killing any people who may be in the room. Try doing these things with gasoline. And, if you only use gasoline and you experience water related problems such as freezing, you add alcohol to the gasoline to solve the problem. In my estimation, if there is something that’s bad in ethanol, it’s the gasoline that's added to the alcohol to denaturize it.


Even if ethanol caused some or all of the engine problems that the oil industry pretend that it does, the solution is not to not use ethanol. The solution is to ban the use of gasoline as an engine fuel and to mandate that all engine components be manufactured with regard to alcohol use. And of course, the ethanol should be produced in America by Americans. Simply put, I’d much rather have my fuel money go to American farmers than foreign terrorists.

Corn Oil Production Segment

Revenues in the corn oil production segment decreased by $0.2 million for the three months ended December 31, 2012 compared to the same period in 2011. During the three months ended December 31, 2012, Green Plains sold 36.6 million pounds of corn oil compared to 31.9 million pounds in the same period in 2011. The increase in volume was offset by a 13.5% decrease in average price for the three months ended December 31, 2012 compared to the same period in 2011. Average corn oil yield increased to 0.61 pounds per bushel for the three months ended December 31, 2012 compared to 0.50 pounds per bushel in the same period in 2011 primarily due to process improvements.

It is quite interesting to read these posts knowing what I know. No, there is not any inside information here, but some sound observation and background.

GERS is defending patents with real intention of winning. However, GERS is not hanging the hat on a one-time slam and payout. GERS has an interest in gaining royalties from COES to fund further development on green technologies. This is not the last gig for GERS. The intersest is to build a legitimate corporation with a long term growth and future.

In the meantime, many GERS employees gave up a substantial salary decrease to keep the company afloat during some lean times and are being reimbursed for those sacrifices with recently gained revenue. Thus profits are low and compensation increases shows an increase for top and bottom management.

It may take some dilution of stock beyond ability to pay creditors and use revenue to maintain a highly qualified and trained staff when there are few in the labor pool having the narrow expertise these employees have that have been through the nuts and bolts assembly of developing this new technology.

Each ethanol production process has its own fingerprint and it is not a one size fits all opportunity. This is why GERS has been successful in acheiving the yeilds for signees due to the service GERS provides each and every royalty payer. At the beginning of the day, it is what GERS does for their compliant ethanol producers that gain payers results at the end of the day.

Another reason you will not see huge net earnings with GERS is because they are long term as I suggest most investors here are. Revenue is being spent on additional forward thinking green technology that could become the next "COES" type technology.

But never trust the courts. This company is well directed technically by DW, financially managed by EC, and held in place by KK. Overseers such as RK and GB contain exuberant variations to the company goals.

For those wanting a quick grand slam on a law suit ruling, be wary. There is nothing in the corporate constitution that says GERS need pay you anything at all. Ownership decisions of the company is well contained within a small group beyond shareholder control. And for the novice invester, let there be a lesson here. Corporate governance trumps minority stock ownership of which all us ourside investers are.

Skunk is more right than wrong, but more wrong than right at times.

He does deserve recognition for what he says and derrogatory comments on this site against ant individual input is meaningless. It only shows your frustration and if you are not mature enough to handle it, please just do not result to text on this site. It goes nowhere and that might just frustrate yoy more into a self deficating situation.

I am saying they do not care about investers. This is wall street financing at its best. I am investing for the very-very-very long-term if they do in the future make enough money and have the desire to grow or build another company, they will need to show shareholder return on this company. Venture investers will tell you if they have a ten percent success rate on cash return investments, they have had a good day. Because they lost money on the 90 percent, but the 10 percent that hit gained them ten fold what they lost on the 90 percent losers. This is is a judgement call on technology, the courts, and management intentions because the common shareholder does not have a vote in any business relations or dividend distributions. Dividend structure is set up so the prferred stock holders get their's first. and the common stock holder is working with only 20% of the approved stock with 80 percent going to a few in cohorts with each other. So only if they want to really make a business with teeth would this show favorability with common stock holders. This is a whipping boy stock being manipulated by few that are given discount debentures at this time and are excersising discount debentures to gain stock, only to turn it around to others at market value. This is typical wall street. Look at the last 10K and notice how Yagi has purchased and filtered out stock to an ever growing number of list of percentage ownership investors. YAGI by contract may only own a 5% total stake, but there is nothing saying YAGI cannot excersize debentures, gain stock at discount and then turn them over to others at profit, only to do it over and over, thus diluting stock and never actually owning over 5%. GERS would stop this unless they were either held by a "smoking gun" or agreed with the practice. If GERS had the cash and wanted to, they could stop this by paying YAGI there interest on the loan agreements.

There is one significant proviso to this thesis that GERS' common shareholders have no leverage with the company, either in terms of the PPS of their stock or market cap of the company. Indirectly we do. It is well known that KK desires greatly to become a CEO of a NASDAQ listed company. He simply cannot accomplish that goal of a lifetime without significantly improving the basic fiscal condition of the company and this includes the PPS and market cap of the common stock, and has NOTHING to do with the value of the preferred shares and the dividends that they afford the inner circle -- NOTHING. Read the requirements for a public company to be listed on the NASDAQ.

Your implication that KK and the inner circle can do anything that they want is far fetched. They do have tremendous latitude and certainly more than a public corporation with a true governance structure. That said, there are limits. For example, if there was a settlement and they used this money for lavish bonuses and did not pay-off the debt and continued to dilute to make expenses this would be a violation of their fiduciary responsibilities defined by the SEC and in law. There are some limits.

The 80% to what you refer is colatral on the loan to the main borrower. They cannot sell it. They have not sold it. They cannot promise to sell it. In fact the prefered shares have not even been converted to common. The preferred shares can only be converted to common in case of default. No one will borrow serious money without colateral. Start a bank and try it if you think you want to be the first bank in recorded history to do it.

Not the great news on the litigation front, not the just finished NEC, not the outstanding earnings of GPRE nor ANDE are capable of putting humpty dumpty together again (increasing the PPS). What will it take? If you have been reading the notorious nobody you would know.

ANDE: Oil Extraction Sets Another Record High

GERS' 2nd largest customer shipped an all time company record of more than 19,000,000 pounds in Q412. This is 2,500,000 more pounds than Q312.

For the full year, ANDE shipped over 59,000,000 pounds of oil.

Oil shipped increased by about 375%, compared to 12,482,000 pounds in 2011.
