Dilution and the OS, SkunK Guesstimate

From 20 May to 20 August we know the OS was steady at 500M. During that time of no dilution the average trading volume was about 6.3M shares a day. That is our non-dilution base.

On Sept 8th the allowable OS was upped from 500M to 10B. From Sept 8th to October 12th the total volume was about 457M and the average volume was 18.27M for those 25 trading days. From October 13th (patent announcement) until the 29th of October, the total volume was 5.173B and the average daily volume was 398M for those 13 trading days.

From prior observations I developed a formula. At times the rate of dilution has a ratio of about 70% of volume (in excess of normal volume). In fact, for those who remember, I was able to predict the day the volume would decrease since the OS reached the original 500M OS.

I have had a self professed "inability" to predict future price. However, my estimates of OS are sometimes scary spot on. Of course past performance does not always predict future performance. (Some of us GERS-a -holics wouldn't still be around if we thought it always did.)

Using these numbers I see a total of 5.63B shares traded over 38 trading days since the OS was raised. Subtracting out the base we get 38x6.3M = 239.4M. 5.63-.2394= 5.39B. 70% of that is 3.773B. Add that to the 500M preexisting shares and we get an approximate SkunK guesstimate of 4.273B shares OS as of cob 29 Oct.

We will get confirmation of the OS - no later than the 3Q on or about the 20th of November. I will try to update my numbers just before the release and then stand by for any verbal beatings due.

I do make math errors, and I do forget stuff. So if I dropped a zero or something drop me a line - my number checking staff consists of a loyal, but old, blind dog. thanks

Following posts say it came from transfer agent. The post is current, however what is the exact date of that os is not clear. If the number is even a few days old, we could both be right. I hope my numbers are wrong and the huge volume consists of an abnormal amount of churning day trades. However, I will stay with me numbers for now . . . as always you need to decide for yourself.

Prayer For Relief

So what is GERS asking for in judgement in this civil case pending? The SkunK found this in a document filed yesterday on the 28th. The money looks like it is mostly in "E" below. They are asking for a reasonable royalty, treble damages and costs.

What happens next? I do not know, but I will be here to find out.

So What is the 'The Trouble With Tribbles'??? Wrong episode - its treble. The SkunK thinks treble damages are common things to ask for and expect if your patent infringement case is valid.
This from Wikipedia: "The ability to award treble damages is a typical feature in legislation that recognizes the potentially willful nature of the prohibited acts. For example, such damages may be awarded by a court in the United States for willful violation of the antitrust laws, for willful patent infringement, for trademark counterfeiting, and under the RICO statute. The idea behind the creation of such damages, also called exemplary damages, is that they will encourage citizens to sue for violations that are harmful to society in general."

GERS in BioDiesel Magazine


I think everyone in the industry reads this magazine. It is the Sports Illustrated of its sector (so far no swimsuit edition). I get it electronically and hardcover at my house. When it matters they publish it.

CEO Web Cast Second week in a Row

Greenshift(OTCBB: GERS), a company that develops and commercializes clean technologies that facilitate the efficient use of natural resources, announced last week that it has been granted U.S. Patent No. 7,608,729, titledMethod of Freeing the Bound Oil Present in Whole Stillage and Thin Stillage.. When you hire a lawyer to write something simple for normal people, (like a full disclosure for a credit card), it gets so complicated you have to hire another lawyer to read it and tell you what it means.

In its complaint, Greenshift stated that Westfalia admitted in a separate lawsuit that the company had infringed on a Greenshift patent for the technology. Greenshift was awarded a patent just last week, according to a news release from the company.

"In fact, Westfalia seems to boast about this infringement by admitting that, as of the date it filed its complaint, it 'sold 29 centrifuges designed for corn oil recovery to 20 different ethanol plants across the country,'" the lawsuit states.

Greenshift has asked the court for a jury trial, to be paid damages by Westfalia and to prevent additional infringements on Greenshift's patent by Westfalia and the yet-to-be-identified ethanol companies that use the technology

Bioethanol production process may be improved by new technologies

GreenShift Corporation has developed new techniques for enhancing biofuel yield and increasing producers revenue. Bioethanol fuel is usually obtained by fermenting sugar from different feedstock - corn, potato, molasses and other biomass. Crude alcohol is then distilled and dehydrated to yield ethanol fuel E100 which can be mixed within gasoline in any blend (E10, E20, E30, E85..). Obviously, fermentation process is quite simple. Under anaerobic conditions, enzymes in yeast convert glucose and sucrose to ethanol. The bigger challenge for scientists is pre-fermentation conversion of the crude corn oil to simple sugar.

Greenshift(OTCBB: GERS), a company that develops and commercializes clean technologies that facilitate the efficient use of natural resources, announced last week that it has been granted U.S. Patent No. 7,601,858, titled “Method of Processing Ethanol Byproducts and Related Subsystems” for the extraction of corn oil. The patent covers processes for recovering corn oil by evaporating, concentrating and mechanically processing thin stillage, a precursor to the distillers grain co-product of corn ethanol production. The patent allows the company to tap into a new reserve of inedible crude corn oil, with an estimated industry-wide output of about 20 million barrels per year. The corn oil is a valuable second generation feedstock for use in the production of biodiesel and renewable diesel, thereby enhancing total fuel production from corn and increasing ethanol plant profits. In related news last week, the company has filed legal action in the United States District Court against GEA Westfalia Separator, Inc. and others in the industry for infringing on GreenShift’s recently awarded patent covering corn oil extraction technology. The suit alleges that Westfalia and others in the industry infringed on the aforementioned patent and that Westfalia solicited several industry members into using the company’s now patented technology well after the patent applications were published. Shares remained unchanged at under a penny on the week.

USDA Official Will Tour Iowa (Corn Oil Extraction) Biofuels Industry

October 16th, 2009

USDA Deputy Secretary Dr. Kathleen Merrigan will get some first hand knowledge of Iowa’s ethanol industry during a tour scheduled for October 20. During her visit, Dr. Merrigan will learn about ethanol production, utilization of co-products and biodiesel research.

Merrigan will first visit Lincolnway Energy, a 50-million gallon per year ethanol plant with a corn oil extraction process.

This from Lincolnway Energy's last 10K:

"Lincolnway Energy began extracting corn oil from the syrup which is generated in the production of ethanol in April, 2009. Lincolnway Energy estimates that it will produce approximately 3,000 tons of corn oil per year. "

If we do a little SkunK math we times these 3,000 tons by 2000 and divide by 7.3? to get the approximate production rate of about .82Million gallons per year from their 50mmgy ethanol plant.

The USDA Deputy Secretary will be visiting a corn oil extraction facility operating just over half the claimed rate of the GERS method I. (1.5mmgy) (If then combined with Method II rates we get about a 3.25mmgy rate. As you can see in the blog below GERS claims a proven rate 4 times that of its competitors. It seems we are working with the right numbers since .82 divided by 3.25 is about 25%).

On October 13, 2009, the U.S. Patent and Trademark Office issued U.S. Patent No. 7,601,858, titled "Method of Processing Ethanol Byproducts and Related Subsystems" (the '858 Patent") for the extraction of corn oil to GS CleanTech Corporation, a wholly-owned subsidiary of GreenShift Corporation.

INFRINGEMENT ACTION
On October 13, 2009, GS CleanTech Corporation filed a legal action on October 13, 2009 in the United States District Court (Southern District of New York) captioned GS CleanTech Corporation v. GEA Westfalia Separator, Inc.; and DOES 1-20, alleging infringement of the `858 Patent.

GreenShift Corporation (OTC Bulletin Board: GERS) announced today that its wholly-owned subsidiary, GS CleanTech Corporation, has filed a legal action in the United States District Court (Southern District of New York) against GEA Westfalia Separator, Inc. and others in the industry for infringing on GreenShift?s U.S. patent covering corn oil extraction technology.
The complaint alleges that GEA Westfalia Separator, Inc. and others in the industry infringed U.S. Patent No. 7,601,858, titled "Method of Processing Ethanol Byproducts and Related Subsystems

The '858 Patent covers processes for recovering corn oil by evaporating, concentrating and mechanically processing thin stillage, a precursor to the distillers grain co-product of corn ethanol production (?DDGS?).


These benefits laid dormant for the 24 years that preceded GreenShifts invention of extraction technology. It is GreenShift's opinion, as outlined in the pleadings, that Westfalia, seven years after it started offering equipment to the ethanol industry, and well after we introduced the market to the benefits of corn oil extraction, took to trivializing our innovations as they solicited and induced many in the ethanol industry into using our now patented technology well after our patent applications were published. GreenShift will protect its investment in its intellectual properties.

GreenShift Awarded Patent for Corn Oil Extraction

NEW YORK - (Business Wire) GreenShift Corporation (OTC Bulletin Board: GERS) announced today that the U.S. Patent and Trademark Office has issued U.S. Patent No. 7,601,858, titled "Method of Processing Ethanol Byproducts and Related Subsystems” (the ’858 Patent) for the extraction of corn oil to GS CleanTech Corporation, a wholly-owned subsidiary of GreenShift.

“The issuance of the ‘858 Patent is a significant milestone for GreenShift and its stakeholders,” said Kevin Kreisler, GreenShift’s chairman and chief executive officer. “GreenShift has a substantial investment in the development of these important and timely new technologies. We look forward with great anticipation to working with the ethanol industry to press the evolution of corn ethanol forward into enhanced sustainability.”

The ‘858 Patent covers processes for recovering corn oil by evaporating, concentrating and mechanically processing thin stillage, a precursor to the distillers grain co-product of corn ethanol production (“DDGS”). Historically, ethanol production facilities have sold DDGS for animal feed, with all of the oil trapped inside. An estimated 3.4 million tons of corn oil passed unrecovered through the U.S. ethanol industry during 2008 alone.

GreenShift’s portfolio of patented and patent-pending extraction technologies can cost-effectively extract most of this corn oil, thereby increasing biofuel yields per bushel of corn by 7% while reducing the energy consumption and greenhouse gas (“GHG”) intensity of corn ethanol production by an estimated 21% and 29%, respectively.
