19 Nov 2018

In these pages you will discover the most complicated, uncomplicated case.  Appellants are the guys with the white hats.  At least that is what it looks like from the Greenshift side of the river.

Appellees move for a forty-day extension of time, until November 19, 2018, to file their response brief. CrossAppellant Adkins Energy LLC also seeks a forty-day extension of time, until November 19, 2018, to file its cross-appeal brief. Appellants oppose any extension longer than twenty-four days.

Upon consideration thereof, IT IS ORDERED THAT: The motion is granted. Appellees’ response brief and Cross-Appellant’s cross-appeal brief are due no later than November 19, 2018.

ten days, twenty, thirty, forty, fifty days...

does not matter as this case has been going on for many more days than all the above added together and multiplied by three.

I can see the infringing companies point of view in that so many lawyers are involved on their side they definitely need more time to pad the bill to their clients who will pay them partially in the royalties that should be going to GERS.

It will be a kind of morbid fascination to once again watch the legal system wind up the gears, cogs, and springs...

What I find comforting in all this 'endless example of time' is that the US Patent office sided with GERS even after all the (censored) things the infringing companies did to GERS and GERS shareholders.

Does anyone know of a comparable case where after what all GERS has been through and yet the US Patent office upheld the validity of the patents, if some US Courts ruled against both the company and Patent office?

My post yesterday predicted that this is far from over... We will have months and months of more of the same. Delays in an effort to bleed GERS continue in classic form and fashion... What would a fly on the wall at ICM have heard? That this is a sound strategy? Just like the settlement rouse!

When will the courts, and this new judge, put her/their foot down and say enough is enough? Let's talk in April or May, earliest...

Anonymous said...

For that strategy to work they would've had to bleed them out years ago. It failed. GERS is still here. It won't work, not now. Not with positive operating income, new licenses and no dilution in 2 years. Not with the legacy debt gone and the threat of another R/S eliminated.

All it means now is more treble damages. Put it on their tab.

That's alright. Give them extra time. They're gonna need it.

Gers look at the 2 year chart. It's about to pop!

Don't get too excited. The end of the rainbow can be visualized but it is not nearly in our grasp. Unrequited expectations are not healthy and can lead to additional discontent as exhibited by posters elsewhere that may hinder our marketability. Many major issues to resolve, many events to unfold before we can party. If I were a betting man (which I must be to hold GERS' common shares), I would wager the over/under time required to grasp that rainbow to be in excess of a year.

Thank you o wise one. I remember you said something like that awhile back but that didn't stop the spike from happening. .01 t0 .22. Another spike's coming!

Spike I would love, but like spontaneous combustion very unlikely for quite a while. And when/if it happens, it is not falling back, not this time!. Now that is a "spike" we can all support and dream of.

Trump To Approve Year Round E15 Next Week!$!$

I will be at the Trump rally in Council Bluffs Iowa for this epic announcement.

The ethanol industry has been fighting for this common sense E15 waiver for years.

Trump is keeping his word!

I can't believe DVG won't be there. It's too important not to be.

Trump is making America great again!

People are working again.

Money is being made.

More ethanol to be produced.

Oil prices are soaring and may be $100/ barrel

I wonder if the infringing companies voted against Trump?

Probably...

I bet GERS voted for Trump though; wise choice.

New Video With GreenShift!$!$

The Attis Innovations video refers to GreenShift and Renewable Process Solutions as partners.

https://www.youtube.com/watch?v=hVavT8IARu4

The RPS photo gallery shows installations of biodiesel systems and what looks to be an oil extraction centrifuge.

https://www.rpsol.com/

I found this under "Biomass to Sugars & Lignin".

"RPS is currently partnered with Waste Management firm located in the United States to develop production scale process to convert biomass to high-quality Lignin and Sugars. The process was designed after many years of R&D work performed by private and government partnership. The method is capable of producing high-quality Lignin that can be blended with plastics and various other products to minimize the carbon footprint. The sugars generated through this process are used to create Ethanol or other high-value products.

We believe the above process methodology will kick-start a new industry that uses Biomass on a large scale to produce fuels and plastics. We expect to commercialize the first production facility by mid-2019."

Obviously, the "waste management" company is Attis, previously Meridian Waste Solutions.
Then there's this. RPS is completing a co-located biodiesel installation at early adopter licensee Calgren.

"RPS is focused on co-locating 3 to 5 MMgy Hybrid.T plants at ethanol refineries with a return on investment of three to five years. The Calgren project is expected to come online by end of year (2018)."

"RPS is also working with petroleum companies to develop alternative approaches to renewable diesel processing."
http://www.biodieselmagazine.com/articles/2516358/pioneering-achievements

Suddenly, Kevin's mention of co-located biodiesel refineries comes to mind. Something GERS has been pushing for years. Will the flood gates finally open for co-located facilities? How about co-located facilities with GERS' patented method 2 oil extraction?

Personally, I need to see more than promises at this point in time, and that's my prerogative. We all recognize what it will take to move the share price higher and that is my only concern right now. I have heard promises for years and years and years...

At the rally, Trump kept his word. He said he understands ethanol, that it's a good fuel. He approved year-round E15 because oil prices are too high. He said it's important to our farmers, jobs and economy.

A lot of issues the industry is having are due to (Pruitt's) RIN waivers given to profitable oil companies. It's taken away billions of gallons of ethanol demand and as a result, we have bloated supplies and $1.32 ethanol. Scott Pruitt is gone and Trump is providing transparency to the RIN market.

I think this approval will get a lot of fuel retailers off the fence. Clarity and confidence to install E-15 pumps and no more hassle of changing labels at the pumps twice a year.

I'm disappointed with ethanol companies. They've fallen behind on innovation. I don't understand why every ethanol producer in the country isn't extracting oil with method 2 and/or producing biodiesel. Instead, they pass this value on to biodiesel producers and big oil companies. The stock price of biodiesel companies has tripled since 2014 (the year I took a break and stopped supporting the ethanol industry). Ethanol stocks have since lost 2/3 or more in value.

Ethanol producers picked the wrong battles, alienated investors as well as the very few allies they had. Fighting over $1 when there's a $100 bill in front of their face. So much wasted time locking horns with big oil. Why not focus on educating consumers and innovating to stay competitive instead?

Ethanol producers wasted too much money, time & energy fighting GERS and they're not making much money. They're not disciplined on production and not moving quickly enough too improve the value of distillers grains through various commercially available methods.

Ethanol plants are a lot like oil refineries. Both can produce gas, diesel, plastics and chemicals. The industry hasn't made it too far past gas/ethanol and that's a shame.

GERS and ATIS will prove to be a powerful combination. If you're going to produce biofuels, you need to actually make money.

Good Luck To All!$!$

President Donald J. Trump Is Expanding Waivers for E15 and Increasing Transparency in the RIN Market

We want to eliminate the intrusive rules that undermine your ability to earn a living, and we will protect the corn-based ethanol and biofuels that power our country.
President Donald J. Trump
EXPANDING WAIVERS FOR E15: The Trump Administration is initiating rulemaking to expand fuel waivers for E15, or gasoline containing 15 percent ethanol.
President Donald J. Trump is directing the Environmental Protection Agency (EPA) to initiate a rulemaking to consider expanding Reid Vapor Pressure waivers for fuel blends containing gasoline and up to 15 percent ethanol.
Under the proposed expansion, E15 would be allowed to be sold year round rather than just eight months of the year.
President Trump continues to uphold his commitment to ethanol and the Renewable Fuel Standard program to give consumers more choice.
The proposed expansion will strengthen America’s domestic energy production and provide a boost to America’s famers.
INCREASING TRANSPARENCY IN THE RIN MARKET: In the same rulemaking, the Trump Administration will increase transparency in the Renewable Identification Number (RIN) market.
In the same rulemaking, President Trump is directing the EPA to consider reforms to increase transparency and prevent price manipulation in the RIN market.
These potential reforms to be considered include:
Prohibiting entities other than obligated parties from purchasing separated RINs.
Requiring public disclosure when RIN holdings held by an individual actor exceed specified limits.
Limiting the length of time a non-obligated party can hold RINs.
Requiring the retirement of RINs for the purpose of compliance be made in real time.
President Trump and his Administration held meetings with various stakeholders, including Members of Congress and State leaders, to hear a range of views while evaluating this decision.
These proposals will go through the formal notice and public comment process.

Trump Signs Legislation To Clean Up Millions Of Tons Of Garbage From The World’s Oceans
https://dailycaller.com/2018/10/11/trump-signs-bill-clean-ocean/

"The issue of marine debris has become an increasing problem on the international stage. National Geographic reported in 2015 that 5.25 trillion pieces of plastic is in the world’s waters, with 269,000 tons of it floating on the surface and around four billion plastic microfibers per square kilometer sitting deeper in the ocean."
