Three words, all of nothing!

Makes me boil that the chorus of scum balls with Vanderscum as the orchestra leader can steal these patents, profit off of the theft, and sleep at night. You don't have to wear a mask and carry a gun to be a criminal.

GERS is asking a lot for the word limit increase by 3 fold. It's a real coin flip but maybe the court will grant this after they see how long this has gone on. Judge Stoll, coming from the patent office, could very well positively weigh the fact that the USPTO did not think there was inequitable conduct as the other courts found.

There is a lot of guilt to go around, including ours.

I quoted several different versions of the negative tone several times in the earlier post. It sounds petulant, even adolescent -- "Change the rules or I am going to take my ball and bat and go home".

They are clearly playing to Judge Stoll's sensitivities, but this is not her first rodeo. She is likely sympathetic to GERS' plight based on her previous rulings but the language in the motion is much too strong and she will obviously know that she is being played.

I suspect that she has seen many complicated cases presented on appeal within the prescribed word limit. There is something to be said about conciseness. If you really understand the issues and the core problems you can surgically dissect them with precise wording and do not need volumes.

I also wonder about the conflict in positions. For many months (years) GERS has stated, "Lets get to appeal and this will be slam dunk". Now they are saying we need to change the rules to win.

All of this is very troubling and I think that they may risk alienating their potentially critical ally -- Judge Stoll.

Everything will be overturned by the higher court with judges that understand patent law.
