Adkins Energy’s Objections Overruled by Court

The court heard argument from the parties regarding the plaintiff's Rule 34(a)(2) request to conduct an inspection of defendant’s ethanol facility and take samples throughout the manufacturing process, according to a protocol described by plaintiff GS Cleantech’s counsel. The parties had scheduled a plant inspection for Tuesday, October 11, 2011, but disagreed regarding sampling requested by the plaintiff. The court ruled that the plaintiff’s discovery request is in accord with the requirements of Rule 34 and Rule 26, and overruled Adkins Energy’s objections to the inspection and sampling.

So what exactly do you call paranoia based on experience? lol
Of course the SkunK would want to see the maintenance log and the valve log and the recent clock rings of the maintenance employees.  Those details would make it harder to hide any recent nefarious "projects" in the vicinity of the oil extraction equipment.  Of course production will show a recent drop if the concentrated stilage heating equipment has been removed.   Remember to always look for the anchor holes in the concrete.  It's easy to move equipment out of the building but awful hard to patch concrete anchoring holes - it is just impossible to match the color of aging concrete.  Exposed untarnished pipe threads - the untarnished gnarl line of a pipe held by a pipe wrench, the SkunK could go on and on about the tell tale scat left at the scene of a crime possible covered infringement.  But why?  I'm sure the GreenShift team will spot a Blazing Saddle cardboard set a mile away.

There was simply no basis to this objection from the start. Other than trying to block GERS from obtaining proof of a smoking gun...

I don't mind going out on a limb in order to make a guess at things. Sometimes I win, sometimes I lose. I too have a handfull of Emails from Valero so there's nobody special here. I was having a nice back and forth with Jim, until the results of the Markman came out. When I asked the question along the lines of, ICM was confident that the Tricanter didn't infringe GERS patents and I pointed out that ICM overwelmingly lost the hearing, does that affect your confidence in a non issued pending patent that still extracts from concentrated stillage? The communications came to an abrupt halt. Maybe nobody can get a response on that one. I do think there is something behind Valero not installing the system at all of their plants. It's like they're not too sure, they're testing it, or they don't want too much liability in the event that ICM's patent is denied. I do believe that Valero, in the end, will sign with GERS. Simply because their system is nothing new, it's obvious, and still extracting from the concentrated stillage. POET will license with GERS in the future as well, IMO. POET is extracting from the same stillage. The only difference is that POET doesn't use heat when they ferment the ethanol(cold cook) which has nothing to do with the methods of extracting from the byproduct. The method of extracting remains the same. GERS has mentioned that POET and ICM's new customers will be held accountable.

Anyway, I think the mystery licensee could be Flint Hills, the #5 largest producer behind Green Plains.

Greenshift has stated that we've gained substantial new business in 2011. From 1 billion in 2010 to 1.9 billion so far in 2011. 900 million gallons this year. Calgren was the last to license in December of 2010. So in 2011, we licensed GPRE, MN(60M), Marquis, WI(70M), Sunoco, NY, (110), Andersons, IN, (110), and Advanced BioEnergy, NE, (110). That's a total of 460M. 900 - 460 = 440. Who's this 440? It's Flint Hills, IMO.

There are many more important issues to be delving into here than the existence of “bogie men”. The effort being expended to support this mania is just that, manic. I am me and no one else; and it is unlikely that “Todu” or any one else would want to be me. What is disconcerting is the possibility that some posters are working to actively deceive us. In that regard Slash may be guilty. Yesterday Slash acknowledged (Yahoo “Flint Hills” tag, 14 Oct 4 PM) that he had also been in communication with the same senior Valero official I had during the time I was trying to clarify the implications of the Valero signing for GERS and that he had the same information. I posted here and on I-Hub that this VP categorically stated that there were no contracts between Valero and GERS and that Valero was going to work with ICM. During this same time period you all remember that Slash was working very hard to convince us of his theory that Valero was going to announce future licenses with GERS (the “mystery” company). The basis of this theory was that the Valero gallons of ethanol would allow GERS to fulfill its year end pledge, much as the argument he is now making for Flint Hills. THE PROBLEM – while Slash was trying to manufacture this obviously future good news he has now admitted that he knew that his contention was patently false. You be the judge, the writings are there for you to read. I press this point not out of a vindictive spirit but to say that many of us have benefited from Slash’s knowledge and persistent digging. It is sad, but necessary that we must now view his contributions with the knowledge that he has impeached his veracity with his own words.

There is too much thought going into a business that is up and coming, stabilizing and becoming a mature company. Speculators should just back out and let management of GERS run the company as is best for all investors. It would be greatly appreciated if the speculation and mud slinging would end and only report factual evidence as does the Skunk.

For the record, I posted my thoughts on Valero one day, the 19th. I began getting communications from Valero on the 20th. Where in the world did you get the idea that I wouldn't give up the notion, that I continued to post otherwise and mislead? You've just been proven a liar with respect to yahoo so show me those posts or be proven wrong again.

For all we know, the real nobody12378 may not be around anymore and todu5613a could have jacked his ID for IHUB.
