ICM Denied Writ of Mandamus


. . . it would be inappropriate to grant this extraordinary remedy merely to strike a recommendation in an opinion that does not rise to the level of an actual decision, the legal conditions for mandamus relief have not been satisfied. The court therefore denies ICM’s petition.

Folks, you do realize that if this desperate maneuver whose only real purpose was to drag out these proceedings had been granted that most of the court and legal activity to date would have been rendered mute? If granted, much of what has been accomplished and decided would have to have been done again! For once, some real news; where is the PR announcing this landmark decision in this litigation?

I will be surprised if we do not see a PR. This is the biggest news to date, in my opinion.

As you can tell I agree and thank you for not chastising my use of the word "mute", instead of "moot". I was in a hurry to get a dialogue established over this ruling. The fact that there is so little chatter about the significance of this order means that folks are not following the proceedings closely or they no longer care. If the latter, perhaps this ruling will get some new blood in here; that ruling along with the fact it appears that (bite my tongue) dilution has become quiescent under EC, may facilitate some hybrid vigor.

This ruling could/should open the possibility for the SJ, even a settlement? Unfortunately, it appears that new financing and getting out from under YAGI is no longer possible due to the 20% poison pill -- I think they will now get 20% of the court award PLUS their interest and principal amount, even if a White Knight was found.

Only time will tell on the dilution front. Perhaps they are at a point that the payments to YAGI will be with cash. The writ of mandamus was ICM's Hail Mary, and the referee called it an incomplete pass, and unnecessary bitching. Let's see where this leads to.
