Here is a free search page that can inform us quickly if Cleantech Corporation v. Pacific Ethanol, Inc. will stand on its own - or if it is only the start of another round of infringement litigation. Putting "Cleantech" in the search line gives initial results faster than the official "pacer" system. I suspect we will know the answer within three weeks. Once a new litigation is established, the usefulness of this search vehicle gets a bit cloudy. Although Pacer charges 10c/page, these private systems charge a premium.

Lawrence M. Kreisler - Lawrence is the sole owner of Serenity Capital, LLC. Built Kreisler Bags, then Kreisler Bags and Filters, then KBF Pollution Control Inc., then KBF Pollution Management Inc. After 1-20 R/S Sept2003 company was taken over by Veridium Corp in Oct2003, controlled by son Kevin. Resigned, effective December 31, 2003, as an officer and director of Veridium Corporation. Continued to work at Veridium's Paterson, New Jersey based recycling facility, that was designed on recycling technologies he invented. His employment was terminated in July 2004 due to irreconcilable philosophical differences in how to best operate and grow that facility. Bronze Parachute included: 100 percent of his salary of $150,000 through December 31, 2004 and 50 percent of his salary through December 31, 2006. Medical benefits until the age of 65. Lawrence is about 61 years old.
Scott Kreisler - Scott is the sole owner of Cyrus Capital, LLC. Brother of Kevin Kreisler, listed as a Beneficial Owner of Veridium Corporation on 4/2/2002 SEC filings. The 2005 annual report also says: "During 2005, Scott Kreisler, brother of Kevin Kreisler, received salaries of $72,700. Scott Kreisler no longer works for the Company." In February 2006, Cyrus Capital, LLC, purchased from GCS Investments $500,000 in convertible debt issuedby GS Clean Tech. As I stated Saturday, the fact that GERS has filed against PEIX is expected based on the statements in the filings. It is the timing that is most disconcerting. The use of another law firm with no IP experience may also be an issue and understanding why C & C was not involved as they where when the Minneapolis IP firm did the initial filings in May, 2010 may be important to this timing decision. These May, 2010 filings carried the relationship between that firm and C & C with the identification of "Of Counsel" for C & C. "Of Counsel" means : The title of an attorney or firm who is employed by a law firm or an organization, but is not an associate or a partner. Until it is stated otherwise, it is reasonable to assume that there is no "Of Counsel" relationship between the Sacramento law firm and C & C.
I think that a huge chess game between KK and DVG is being played out with the GERS' common shareholders as the pawns. I hope that I am wrong but statements by current holders of GERS' common stock exemplify potential investor reaction -- no more money going to GERS until the presses stop. Did DVG just put KK's king in checkmate? By indemnifying PEIX so deeply into the litigation clearly going GERS' way did DVG waive a red flag at the bull, KK, that he could not refuse to charge? If no other funding/financing is put forward to pay for this second front and the costs of the new law firm many are suspicious that we will pay through dilution. BUT, most are tired of witnessing this dilution and will not add to the nearly $120 million that common shareholders have poured into this over years. So, what happens if KK can no longer sell shares to pay for this new commitment? Is bankruptcy then on the horizon? If so, it was a master move by DVG to entice the bull to charge into this front.
I periodically, reevaluate if I am willing to put more money on the table. The odds of the outcome influence this decision greatly. Until we get answers to at least some of these questions the odds just changed and not in a good way. No more money on the table, and if many others feel the same way, what will happen if KK cannot sell his shares?

To me, the new patent infringement lawsuit filed against PEIX is a perfected package wrapped up by Cantor Colburn, stamped with 2 Markman rulings, and topped with a double-checked bow, compliments of the USPTO.
Wilke, Fleury, Hoffelt, Gould $ Birney is one of the most reputable lawfirms in California. They're one of the oldest too, in business for 80 years. They specialize in business law. Cantor Colburn has done a wonderful job, they've been in business 40 years. Since their offices are in Washington, D.C., Atlanta, Houston, Hartford, and Detroit, WFHGB has been hired as the "UPS driver" to deliver CC's perfected package.
GERS has explained time and again that cash being raised was for expanding the litigation. They've been adding $400K in cash about every quarter lately. GERS is also repaying YA at a rate of 2X's more than last year, limiting dilution.
If CC is $50K a month, WFHGB shouldn't cost much. Especially since they're just down the street from PEIX in Sacramento.
Another aspect is the lawsuit mentions Stockton, the plant with Edeniq's system. Edeniq doesn't indemnify infringers that I've ever heard of. Edeniq certainly didn't indemnify Amaizing Energy when ANDE settled the lawsuit. So PEIX is directly involved now, burning millions in cash they don't have. This is an excellent move by GERS and CC.
This is an excellent move with perfect timing. Right as PEIX starts it up. I believe an injunction against PEIX is coming much sooner than most here expect.

A lot of positive assumptions, similar to those that have not panned-out in the past. Because the assumptions are good for GERS doesn't make them true; it makes them wishful thinking until proven otherwise. Sounds like the Disneyland theme and wishing upon a star.
For example:

If you know these facts to be true you are an insider divulging information incorrectly, and that is a crime. I do not think you are a criminal therefore you do not know these statements to be true. Remember the old age, beware of the used car salesman promising too much.
