The cadets here have very little "investing" acumen. They view their purchase of a handful of shares as a way to immediate riches. They have no idea what the issues are, they do not care. They are dazzled by the prospects of turning a $100 in to a $1 million. Obviously such performance can only occur if GERS takes on a mythical stature. This is much akin to a religion and stamping out what is considered heretical and blasphemous thought. They are absolutely rabid, to the point of being a deranged pack of animals, that I delight in throwing a little meat their way in order for me to revel in their flying sputum, snarling, emasculated fangs, and spurious defecation while attempting to mark their turf, and defend their cult.

I am seriously hoping that I can provoke some of them to escape the pack and embark on criminal activity of documented and traceable terroristic threats -- that would be such sport. I sense that we are getting close. The idiots have not yet identified the address I posted as a police station; they are too busy howling at shadows.

The biodiesel industry has another solid month in September producing 86 million gallons of biodiesel. Year-to-date, production is around 843 million gallons and if strong production numbers continue will set a new total biodiesel production record in 2012. The industry set a record in 2011 producing 1.1 billion gallons.

Method II Expected To Become Vital For Dairy Cows

In California, We've seen Calgren license GERS' method II, and Aemetis install a corn oil system that's based on GERS' patents. I don't know of any producer that's using SRS equipment, that doesn't have a license with GERS.

Remember what Mr. Kreisler said about Greenshift (GERS) Method II?

"One of the new licenses we executed during 2011 (Calgren) provides for the first-ever commercial deployment of our patent-pending Method II whole stillage extraction process, a technology that is expected to become vital to ethanol producers that sell their distillers grain to the dairy markets. "

De-oiled DDGS(WDG in the case of PEIX/Calgren) can be fed to dairy cattle at a higher inclusion rate than traditional DDGS. From my research, DDGS without the oil extracted has an oil content of about 9%-10%. Method I reduces the oil content to roughly 5%-6%. Method II should bring it down to around 3% which is the amount of oil that's naturally available in a whole kernel of corn.

The proper amount of oil in a dairy cow's ration is important because too much oil can cause milk fat depression issues. Method II will align the oil content with that of corn and will allow for optimum milk production while lowering the ration cost.

With method I, more of the byproduct can be fed to dairy cows. Method II will take that to the next level.

"General research into the subject has shown that increasing concentrations of low-fat distillers grains have correlated to increasing efficiency of milk production. “When feeding regular DDGS you really have to limit feeds with high levels of unsaturated fatty acids and may cause limitations in formulation procedures,” said Paul Kononoff, Associate Professor of Dairy Nutrition/Dairy Nutrition Specialist at the University of Nebraska in Lincoln. “The reduction in fat in low fat DDGS allows for higher inclusion of the co-product without the worries of milk fat depression.” Kononoff and others at the University of Nebraska have performed trials."

California has more dairy cows than any other state. Method II is expected to become vital to the dairy industry. It's no wonder Calgren made a well informed decision to go with GERS' method II. Not only will they have twice the volume of biodiesel, but the oil content of the method II DDGS is perfect for dairy cows. I can't help but wonder if PEIX is taking this into consideration.

This could explain why PEIX is in discussions with other vendors to install corn oil extraction in their other plants.

I believe GERS' method II is in PEIX's best interests. It would get the stock above $1, IMO. Method II is capeable of 1.33 pounds of oil per bushel. The system they're installing in Magic Valley is expected to do less than half that.

They have the most ethanol production in a state that has the most dairy cows and method II makes the most sense.


Three Reasons For PEIX/GERS

Maybe PEIX is waiting for GERS method II(1.33 pounds of oil) which will be ready by the end of the year.

Maybe GERS and PEIX are getting financing ready for this system. PEIX could have had ICM install their lower yielding system(.50 pounds of oil) in PEIX's California plants, but they didn't. ICM was even willing to give them the upgrade, like they did in Magic Valley, which PEIX will be paying for from corn oil revenues, so why did they decline?

I think there's three reasons.
#1 Method II is the best option for CA's dairy cows because too much oil in WDGs lowers milk production. The more oil that's removed, the more WDGs that can be fed to dairy cows.
#2 Method II extracts more than double the amount of oil that the ICM system is capeable of. That means 2X's the amount of biodiesel and the California market puts a premium on that fuel.
#3 Method II qualifies as an advanced biofuel technology under the LCFS in CA. The production of biodiesel at PEIX's plants would make the carbon foot print one of the lowest in the nation thus competing with Brazilian ethanol.

Advanced BioEnergy Fairmont Is In Good Hands

ABE got into a complicated bind. Due to a dispute with RPMG and an already tight supply of rail cars, cars to transport ethanol were not available. The oil boom in North Dakota contributed to this. ABE was forced to return the 200 rail cars they had and starting October 1, would have had major problems transporting the fuel. ABE would most likely have had to shut down because of a limited supply of cars. Flint hills is a big oil company and will be able to fix this situation. The ABE plant is in good hands.

"The supply of ethanol rail cars in the market is extremely tight, which could affect our ability to obtain new tanker cars or negotiate new leases at a reasonable fee when our current leases expire."


"As previously disclosed, on December 21, 2011, the Company’s subsidiary ABE Fairmount, LLC (“ABE Fairmont”) commenced a lawsuit against Renewable Products Marketing Group, LLC (“RPMG”) in Hennepin County District Court in Minneapolis seeking injunctive relief and damages. The ABE Fairmont complaint alleged that defendant RPMG breached its obligations under an Ethanol Fuel Marketing Agreement and a later oral agreement by refusing to assign to ABE Fairmont a lease for 200 rail cars. ABE Fairmont sought (i) injunctive relief to require RPMG to abide by its contractual obligations, (ii) damages caused by RPMG’s breach of the agreement, (iii) a declaratory judgment, and (iv) other necessary relief. Defendant RPMG answered the complaint denying the allegations and sought a declaration that RPMG was entitled to possession of the cars after September 30, 2012.

In an order dated June 28, 2012, the Court denied partial and full cross summary judgment motions respectively brought by ABE Fairmont and RPMG, finding that there were genuine factual disputes and that therefore summary judgment was inappropriate.

The Court subsequently issued an order dated July 31, 2012 granting ABE Fairmont’s request for a continuance in the trial, originally set for August 1, 2012, and directing ABE Fairmont to return the 200 rail cars to RPMG on or prior to September 30, 2012.

The parties held a scheduling conference with the Court on August 3, 2012. The Company expects the Court to issue an order dismissing the ABE Fairmont claims for injunctive relief and a declaratory judgment, and to set a new trial date concerning the Company’s claims for damages based on breach of contract and other causes of action.



Item 1A. Risk Factors

There are no material changes from risk factors as previously discussed in our September 30, 2011 Annual Report on Form 10-K, except the following:

The current supply of ethanol rail cars is very limited, which could affect our ability to obtain new tanker cars and adversely affect our operations.

We transport our ethanol to our customers primarily via tanker rail cars. As of June 30, 2012, we were leasing ethanol tank cars whose leases expire at varying times over the next seven years. We require tanker cars to ship our ethanol to customers, and would have to lower or cease production should we not have sufficient cars available.

There has been increased demand by the oil industry for the type of tankers used to transport ethanol, as a result of increased production in the Bakken shale oil fields in North Dakota and Montana, as well as the Eagle Ford shale oil fields in Texas. The light viscosity of the oil being produced out of these fields, and the lack of pipelines to transport oil from these fields to major collection points has caused the oil industry to utilize the same type of tanker cars used by the ethanol industry. This increased demand has severely constrained the available supply of tanker rail cars during the past twelve months, and caused tanker car lease rates to increase significantly above historical rates. We expect lease rates to remain high through at least fiscal 2013, as we expect demand for tanker cars to remain high due to the continued growth of shale oil production, the flexibility that rail car transport affords the oil producers, and the continued lack of pipelines to transport oil to collection points.

Our subsidiaries entered into several agreements dated May 4, 2012, and amended July 31, 2012, with Gavilon, LLC, and affiliated companies ( “Gavilon”). In order to ensure a continued source of rail cars for our South Dakota operations, these agreements include the renewed sublease of rail cars for periods expiring June 30, 2014 through June 30, 2019. These agreements became effective August 1, 2012.

Our ABE Fairmont facility currently leases 200 rail cars under a sublease with Renewable Products Marketing Group, LLC. As described in Item 1, Legal Proceedings, our ABE Fairmont subsidiary sued RPMG in Hennepin County District Court in Minneapolis seeking injunctive relief and damages. The Court denied each party’s summary judgment motions in the lawsuit, granted ABE Fairmont’s request for a continuance in the trial originally set for August 1, 2012, and directed ABE Fairmont to return the 200 rail cars to RPMG on or prior to September 30, 2012. We expect the Court to issue an order dismissing the ABE Fairmont claims for injunctive relief and a declaratory judgment, and to set a new trial date. As a result, ABE Fairmont will not be entitled to use these rail cars after September 30, 2012.

We have replaced a portion of the 200 tank cars that ABE Fairmont will be returning to RPMG by September 30, 2012, and are attempting to obtain replacements for the remaining cars needed at ABE Fairmont. If we are unable to replace all or some of the rail cars we need to ship ethanol from Fairmont, Nebraska beginning October 1, 2012, we may have to lower production at that plant, or market and sell our ethanol in a different manner, either of which could materially adversely affect our profitability. We cannot offer any assurance that we will be able to obtain the replacement cars required at a reasonable price or at all. Even if we are able to obtain replacement rail cars, if we are required to lease the cars at prices significantly in excess of our current lease rates, our future profitability could be adversely affected."

This site went from informative to manipulative. It appears there are two main factions now posting comments. Those filing the lawsuit and those defending the lawsuit. In the end, there will not be a clean winner just as this site has been corrupted for those who are seeking real investor information.
