Infringement

Here are four combined documents GERS used to recently request Summary Judgment of Infringement against Lincolnway. Five documents total (one is hidden). In a massive filling of documents I count at least 16 total requests for summary judgment along with the supportive filings. I figure that covers all the defendants. I imagine they are all very similar - except for the redacted portions which describe each of the defendant's COES results.

For this stock to do anything there needs to be volume, it's not getting it from patents or litigation motions...why?

Debt clock?
Litigation is going to drag on and they will get spent out?
Market viability?

They are no doubt a high risk, high reward stock but the latter "reward" needs volume and it's not there. I have a small play on this one considering more but can't get around the volume being so low? Any thoughtful discussion on this...

Th folks that have kept the volume high for many years have either departed or are spent, others tire of the lack of transparency. Many newbies talk a good game but put no money on the table. Until either the litigation is resolved through settlements (final adjudication is off in the distant future), or new financing materializes real new money will be hard to come by and the volume will likely lag. The most critical is the financing, with a large note due at the end of this year that GERS cannot possibly fulfill, without the loan being renegotiated or a new "sugar daddy" found that will not drain shareholder equity. It is truly impossible at this time to value this as an investment for these and other reasons. Thus, this is a wild gamble now, that several of us chose to take, because the potential reward is now commensurate with the risk -- very high. However, until GERS becomes an investment it may be hard to attract the kind of interest necessary to move the PPS north consistently.

The good thing here is that most of the current class of cadets will pass on to other ventures soon, and perhaps the next class will be willing to engage in interesting repartee.

ADM Pioneered Front-End, GERS Pioneered Back-End

ADM/Cargill

I live 30 minutes from Cargill's plant in Blair. I've been there. It's a huge plant that sits on 600 acres. It's also a wet mill, just like their other plant's in Eddyville and Fort Dodge, Iowa.

Roughly 80% of ADM's plants are wet mills as well. Food grade corn oil, the stuff at the grocery store, comes frome ADM and Cargill. This corn oil is extracted from the front-end by hexane gas extraction. It's expensive, not very profitable and is a process that's been around for a very long time.

ADM actually pioneered this front-end process, just like GERS pioneered the process on the back-end.

http://investorshub.advfn.com/boards/read_msg.aspx?message_id=73784443

Despite any noise you may hear, somebody is barking up the wrong tree if they think ADM or Cargill infringe GERS' portfolio of patents.

In fact, the opposite is true. Cargill is one of BIOF's largest shareholders, and as you know, BIOF is licensed with GERS.
http://www.cargill.com/news/releases/2006/NA3008184.jsp

ADM does have some dry mill plants, but according to their website, they aren't extracting oil at this time. IMO, the door remains open for GERS in the 20% of ADM's plants that are dry mills, if/when they decide to do it.

Any suggestion that GERS must take on ADM or Cargill is completely without merit, just like ICM's claims in court.

Not A Peep Out Of POET Since Final Rejection Letter

I wonder why?

So POET doesn't want to tell the world about how they were denied the patents that GERS' owns? I mean for a while there they released a steady stream of news bragging about the pending corn oil patent.

They don't want to talk about it now or what?. Are they embarrassed, scared of getting sued?

Is POET negotiating with Greenshift now? I'm not sure but while POET's application was getting denied, Greenshift was getting additional patents issued.

http://investorshub.advfn.com/boards/read_msg.aspx?message_id=78896157

POET has zero patent protection and I think they need some these days.

Aemetis Ethanol COES In Keyes, California

Is Aemetis licensed with Greenshift? They have a 55 MGY plant in Keyes, California that they just completed a COES in. Aemetis expects 2 MGY in corn oil. This amount of extraction fits GERS' claims of .8 pounds per bushel. Nobody else is getting these types of yields except GERS. I think there's a strong possibility here.

2012 Designed, built and operate Corn Oil Extraction unit at Keyes

About 2 million gallons per year of extracted oil for biodiesel or animal feed

Reduces carbon footprint of biofuels produced at Keyes plant by increasing yield

http://www.energy.ca.gov/2011-ALT-1/documents/2012-08-01_workshop/presentations/02_Aemetis_McAfee.pdf

2 MGY X 7.6 pounds = 15,200,000 pounds
55 MGY ethanol / 2.8 gallons = 19,642,857 bushels

Good Luck To All!$!$!$!$

$5 To $10 Million Biodiesel Plant Contract For GERS?

I believe I have discovered some substantial news. I think I figured out what GERS was saying when they said they have interest in other systems and processes. I believe I know who it is.

Who wants to know?

I'm working on this post now.

This is very exciting!$!$!$!$!$

P.S. Hint: It's at an existing customer's plant. GERS has been trying to get biodiesel plants on site at ethanol plants for years. I think it's finally here!$!$!$!$!$

There is nothing better than watching Nobody get pimped. You can tell when Nobody is losing his argument. He(or she; kind of hard to tell) starts in with the bigger and fancier words to hopefully make you think he's(she's) smarter than he(she) actually is. It's called "peacocking." I've been watching this for years and it is entertaining, to say the least.

Anonymous said...

Slash,

POET's denial was not based on overlap with GERS; it was rejected because it's not novel. Ultimately I think this is bad for GERS as infringers could use the same logic PTO did.

nobody123789 said...

This just demonstrates the depths to which vendettas rear-back and hit the initiator in the face. The message that was deleted simply stated that we were going to contact Aemetis, Inc (AMTX) directly and inquire about whom they have licensed their COES, instead of continued pied piper speculations. This contact has been made and we will soon have the answer that will be shared on the sane blog.

Incredible how vitriolic the disciples become when there is down day for their beloved GERS.

Anonymous said...

Anybody feel vitriolic?

"This just demonstrates the depths to which vendettas rear-back and hit the initiator in the face"
More likely not everybody knows that GERS went down yesterday, not everybody is a incessant poster and tick watcher.

nobody123789 said...

More likely most real investors do not want the air waves clouded with refrains from the Hallelujah Chorus and take exception to blind ignorance as meaningful communication.

Anonymous said...

The plant in Keyes is not a GERS plant. I know because I have seen the system they installed and it is a homegrown and designed system utilizing refurbished centrifuges.

nobody123789 said...

I have contacted the plant manager for confirmation as well. Thank you. This appears very similar to the situation several months ago when REX was proclaimed to be a likely licensee, which upon communication with the plant manager was determined to be incorrect. We must remain vigilant to the siren call of the pied pipers.

Most disturbing, if true, is why are plants opting for sub optimal yields and technology when the importance of co-products is increasing? Is it marketing, is it the royalty which we now believe to be closer to 10%, is it the cost of installation? There must be good business reasons why these plants including PEIX have opted for a different direction.; there management are not idiots.

I doubt that we can have an intelligent discussion here or on I-Hub about this important issue as it raises possibilities that are considered blasphemy.

Anonymous said...

Your idea, Nobody, of an intelligent discussion is if we all just agree with you. That sounds like a real Hallelujah Chorus to me. What do I know? I'm just one of the Bozos, as you put it.

nobody123789 said...

B.S. I hate blind agreement, that is called group think and adds nothing to our knowledge base. I also hate blind faith that all is well that results in a willingness to accept the positive and refute what appears to be negative by attacking the messenger. The disciples are now reaping what they have sown, in spades!

Calgren Seeking Permit To Install Biodiesel Production Facility

"In addition, future results may be improved by the impact of event-driven systems integration contracts as we continue to receive significant interest for our engineering and other services in connection with the design, construction, integration and modification of corn oil extraction systems and other new systems for existing and prospective licensees. We are currently party to a number of such agreements which can be expected to contribute to revenue during 2012."

"1. Co-located BioDiesel Plant/Integral Refining"
http://patft.uspto.gov/netacgi/nph-Parser?Sect1=PTO2&Sect2=HITOFF&p=1&u=%2Fnetahtml%2FPTO%2Fsearch-bool.html&r=1&f=G&l=50&co1=AND&d=PTXT&s1=7935840.PN.&OS=PN/7935840&RS=PN/7935840
"GreenShift has the engineering, construction, management experience - and the patents to build continuous flow modular 5 and 10mmgy biodiesel plants adjacent to Ethanol plants. Since this is commercialized technology - ready for prime time - this would be my first guess. On the recent GreenShift video it is explained that the corn oil produced could be used to fuel the hundreds of trucks that supply the Ethanol Plant. With an Integral Refining facility that could literally make that happen. The Ethanol facility would capture not only the value of the corn oil, but also the value added as it is converted from corn oil to Biodiesel in a true multi-fuel refinery."
http://greenshift-gers.blogspot.com/2012/01/and-other-new-systems.html

"Speaking to a fuels committee of the state agency, Pixley-based Calgren Renewable Fuels president Lyle Schlyer said they hope to encourage local farmers to grow grain sorghum(milo) in enough quantities to replace as much as 20% of the Midwest corn they import by the trainload now. Using milo requires few modifications to the plant to make ethanol and other co-products."

"The diversification goes beyond feedstock. Schlyer says they are also seeking permit modifications to install a biodiesel production facility at their Pixley plant. “Using our extracted vegetable oil as feedstock, we believe we can produce some of the lowest carbon intensity biodiesel in California and not have to ship that stuff back to Illinois, to find a processor who is well suited to use it.” He adds the investment could be in the $5 to $10 million dollar range."

"Pacific Ethanol like others, is adding corn oil extraction at 4 plants in the West that will give them another high value co-product to sell as did Calgren in Tulare County last year, helping them to move to profitability."

"Aemetis recently designed, built and began to operate a corn oil extraction unit at Keyes that will produce about 2 million gallons per year of extracted oil for biodiesel or animal feed and reduce the carbon footprint of the facility that will be important over the next few years to comply with the state Low Carbon Fuel Standard. The LCFS mandates a cut of our fuel’s carbon emissions by 10% to reduce global warming."

"Tony Beam, the Plant Manager of Advanced BioEnergy stated:"

"This corn oil extraction process now . . . gives us the ability to produce another fuel at this facility of BioDiesel. We will produce 8 trucks a week . . . "

Good Luck To All!$!$!$!$!$!$!$

Anony 8;14,

Can you provide any more details of your observation?

Anonymous said...

One note on sorghum- the oil does not yet have an RFS2 pathway approved so it can't be used for biodiesel. Shouldn't be controversial, but takes time to get done with EPA. Also, I've heard a wide range of estimates for oil yield- anything from a lot lower then corn to a little higher; so it's unknown if the sorghum plants will be a good play for GERS or not.
