This is a civil proceeding. GERS cannot bring criminal charges, that is the government's role. If fraud or other crimes have been committed then some prosecutor will need to bring charges, if they believe he can be convicted. In other words, I have no idea.

How do I feel about it? The law is the law, like it or not. Does a ship's captain deserve imprisonment for trying to save a sinking ship and the crew on board? Do bankers deserve more than a slap on the risk for taking one sided bets using borrowed money purely for personal gain? We can all argue whether the law is fair or not, but if the fact is that an action is not criminal, then wishing a prison sentence on someone is inconsequential. If ICM/DVG are as wilful in infringing as some here think and the judge agrees, then the financial penalties will probably be as big a blow to the company and individual as any prison sentence.
