The original submisssion was denied but they had xxx amount of time to refile. Don't know if they ever did, as nothing posted to that effect. They may be relying on calling their Original Patent "Pending"! Maybe they are Optimists!

Seems odd that Poet would have even attempted to file a patent. I know they use a duel centrifuge approach. I'm pretty sure that company had already developed and advertised that concept before Poet and another company had filed for there patents.

From what I have learned larger companies don't give a hoot about patent rights -- they assume that their team of lawyers, which are already being paid, can outlast "David", the much smaller company. In fact, this happens very often. The key to GERS' success is obtaining new financing so that they will demonstrate that GERS is going to over come the delaying strategy. In other words, they will be here to hold the sword of treble damages over their head. Once that becomes a reality watch the rats settle, watch the "Goliaths" fear "David". Until then it will be a free for all with many companies that do not respect these rights.

At first glance it appears that Poet can state that their technology is "patent pending" as long as an application is on file with the USPTO.

According to the USTPO:

the expression "Patent Pending" as such does not protect an invention until the actual patent is published and/or issued:

"A patentee who makes or sells patented articles, or a person who does so for or under the patentee is required to mark the articles with the word "Patent" and the number of the patent. The penalty for failure to mark is that the patentee may not recover damages from an infringer unless the infringer was duly notified of the infringement and continued to infringe after the notice.

The marking of an article as patented when it is not in fact patented is against the law and subjects the offender to a penalty. Some persons mark articles sold with the terms "Patent Applied For" or "Patent Pending". These phrases have no legal effect, but only give information that an application for patent has been filed in the Patent and Trademark Office. The protection afforded by a patent does not start until the actual grant of the patent. False use of these phrases or their equivalent is prohibited".

The use of the term "patent pending" or "patent applied for" is permitted so long as a patent application has actually been filed. If these terms are used when no patent application has been filed it is deemed as a deceptive act and a fine of up to $500 may be imposed for every such offense. Under the current interpretation of "offense", each mis-marked article constitutes an offense, which permits theoretical damages in the hundreds of millions of dollars for high-volume consumer goods.

Appreciate SkunK Blog; where Posts don't disapear when you ask Nobody a question, or several. His "Learned" Response is the Infantile Personal Attack, but never an answer. When everyone quits Posting on I-Hub I wonder if they compute the loss from Revenue?
Or, do they get flat rate advertising payments? If based on "Hits" on the site, Nobody is becomeing expensive on the GERS Site. Oh Well~~~~~~~~Dhole

When I questioned ihub admin about deleted posts, their response was that any post about another person is off topic, and will cause the post to be removed. Their board, their rules. It apparently takes some people 100's of deleted posts to get the hint.

In regards to the newest patent...

Remember when Advanced BioEnergy said they were exploring Greensift's other technologies?

They said,
"...evaluating GreenShift's additional technologies to take advantage of additional opportunities to enhance our bottom line."

"...the addition of new technologies as they make sense for our business."

"Advanced BioEnergy will also have access to GreenShift's portfolio of proprietary technologies to support Advanced BioEnergy's efforts to further enhance by-product revenues beyond corn oil extraction."




At the time, GERS was saying things like,
"...pressing forward with new technologies designed to further enhance the profitability of our licensees."

"...our portfolio of strategically-compatible cleantech"

"...and to continue to improve upon our technologies serving the ethanol industry."

"We will continue to expand our patent portfolio. We have many additional patents pending and we will remain committed to developing new technologies to further enhance the profitability of our licensees."


"..we have recently experienced a significant increase in interest for our...other new systems for existing and prospective licensees."

Well now there's confirmation from Advanced BioEnergy (As well as Green Plains) that their next project is improving ethanol yields per bushel. Green Plains flat-out stated that it involves mechanical processing of feedstock.

"Over the next twelve months, we will continue our focus on operational improvements at each of our operating facilities. These operational improvements include exploring METHODS TO IMPROVE ETHANOL YIELD PER BUSHEL and maximizing production output at each of our plants."

There's also confirmation from Greenshift, in the Q112 report, that they'll be licensing new technologies to producers this year.

"We expect to achieve increased economies of scale with respect to our costs of sales and gross profit as all of our existing licensees commence production and AS WE EXECUTE NEW LICENSES FOR OUR VARIOUS TECHNOLOGIES"


"..and access to new technologies for further gains in licensee profitability and competitive advantage."

"In addition, future results may be improved by the impact of event-driven systems integration contracts as we continue to receive significant interest for our engineering and other services in connection with the design, construction, integration and modification of corn oil extraction systems AND OTHER NEW SYSTEMS for existing and prospective licensees."

"We are currently party to a number of such agreements which can be expected to contribute to revenue during 2012."

"and the degree to which we provide event-driven systems integration services to our licensees involving the design, construction, integration and modification of licensed technologies."

I think this all boils down to the new patent that was just issued for methods of improving ethanol yield per bushel.

"Methods for enhanced processing of biomass using flash desiccation and/or mechanical hydrodynamic cavitation."

Green Plains continues to speak of a new method of increasing ethanol yield by using a mechanical process.

"We continue to work on improving our yield in the ethanol segment and going after the last 7% starch in the corn kernel that remains after the production progress."

"some of the processing and grinding processes"

"We have seen and it’s going to kind of going to come either biologically or mechanically. And so we’ve been working more on the mechanical side of it..."

This was mentioned again in their recent investor presentation.

When did any of the Yahoo gang obtain the brains enough to find another site? Please keep your personal attack on family members on a site that encourages infantile behavior.
