Maybe King David will pay. Maybe not.
The facility in question is in poor shape, thus its mothball state and bankruptcy. Noble is spending $28 million beyond the $2 miliion COE equipment to get the plant to startup status.
I am not sure who built that plant, but if it was ICM, you can bet ICM is doing the $28 million and probably would not do that without the COE sale. On the other hand,Fagan's back yard so that may provide insight.
Otherwise, $2 million is about the cost for the equipment with profit margin only and not the installation, which again may give the the EPC contractor some muscle. Find out if ICM is doing the EPC work and you may have your answer.
However, since they claim $4 to 6 million in corn oil profits for a small facility, it is most likely the highest corn oil yield system. Also, noble Americas is a noble company that one would think honors patent law since they have many of their own.
Earnings release today? If not, should be any day then...
In the past many years GERS has only filed a 10K in mid April.

Not for Q4 do a little homework.
If any one is expecting results from the next filing to provide any impetus for positive progression in the PPS, I think that you will be disappointed. Unlikely to happen until this round of the litigation is concluded.

GERS' Licensee Redeems Convertible Notes
This can only be interpreted one way, good news. GERS' largest licensee continues to grow stronger, reduce debt, and buyout competitors. GPRE beat VLO to the punch with the purchase of the BIOF plants. With the way Mr. Becker runs his ship, VLO will soon sink to the #4 spot with GPRE rising to #3 largest producer in the world.
Green Plains Announces Redemption of 5.75% Convertible Senior Notes Due 2015
OMAHA, Neb., Feb. 14, 2014 (GLOBE NEWSWIRE) -- Green Plains Renewable Energy, Inc. (Nasdaq:GPRE) announced today that it has given notice of its intention to redeem all of the outstanding 5.75% Senior Convertible Notes due 2015 (CUSIP 393222AB0) (the "2015 Convertible Notes") pursuant to the provisional "optional redemption" right in the indenture governing the 2015 Convertible Notes. As of February 13, 2014, there was $90.0 million aggregate principal amount of the 2015 Convertible Notes outstanding.
Any 2015 Convertible Notes outstanding on March 20, 2014 will be redeemed in cash for 100% of the principal amount, plus accrued and unpaid interest to, but excluding, the redemption date. The 2015 Convertible Notes are convertible at any time prior to 5:00 p.m. Eastern time on March 19, 2014 into shares of Green Plains common stock. The current conversion rate is 72.5846 shares per $1,000 principal amount, including the make whole shares (equivalent to a conversion price of approximately $13.78). Green Plains will make an adjustment to the conversion rate as a result of a recently announced cash dividend on its common stock immediately after the record date of February 28, 2014. On February 13, 2014, the closing price for Green Plains common stock was $24.70.
A Notice of Redemption was distributed to all registered holders of the 2015 Convertible Notes on February 14, 2014.

Yes, GPRE is swimming in revenue, we are mired in debt and so far sub penny that a "20 bagger" would not get us to a penny. GPRE revenue does not translate in any direct way to GERS' revenue. Anyone figure out yet what is wrong with this picture?

What does this have to do with GPRE's success not able to impact GERS' dilution required to pay bills? Please explain? Do you know how to spell "substantive"?
