Although the Court does not believe it is necessary to re-construe claim terms
that have already been briefed (some of them more than once), . . Therefore, the Tag-Along Defendants shall file any said motion regarding constructionof additional claim terms no later than two weeks after CleanTech serves its preliminary infringement contentions.

  19. Others here with more knowledge may correct me, but I believe that VFIN has been the point for dilution dumping by YAGI and/or GERS. We may have our answer -- the typical dilution bolus fired into any up-tick in the PPS. If true that OS share count in April will exceed a billion.

    I think it's good news the judge isn't willing to re-construe the all important claim terms for a 3rd time. Those are set in stone and heavily in GERS' favor.

    $100 bucks says Patent Infringing PEIX/AMTX are unable to convince the judge that additional claim terms need construed. Any Takers?

  51. Another litmus test failed. As usual a huge bolus of dilution shares were fired into the up-tick to bring it back down. I am curious how much more it will drop, how many more shares will be diluted tomorrow? We will hear that we do not know that dilution has occurred, my response always is wait until the SEC filing comes out, and every time this has documented more and more dilution. I would be shocked if we were not in excess of 1,000,000,000 OS now. But I am as shocked how many fail to accept the reality that nothing good is going to happen until we rid ourselves of YAGI and now that cannot happen until we collect the court award from the current round of litigation; and that is still many months probably two years away.

  72. Explosion Forces Defendant Big River to Shut Down

    Defendant, Big River, gets a 3 day vacation from treble damages.



    NEW YORK (DTN) -- A source at Big River Resources Boyceville LLC confirmed the company's ethanol production plant with an annual nameplate capacity of 55 million gallons was forced to shut down Monday through Wednesday because of power shortages tied to a shortage of natural gas.

    Severe cold weather in the Midwest that spurred heavy demand for natural gas and tightened its available supply was exacerbated by an explosion Sunday, Jan. 26, on a natural gas pipeline in Canada that disrupted supply to the Upper Midwest.

    After the lost natural gas supply from the pipeline explosion, many customers in the Midwest region were left without heating earlier this week, prompting the local power company to ask customers to conserve energy.

    A pair of ethanol plants in western Wisconsin were said to have shut affected by the power shortages, with the Boyceville plant being one of the two.

  74. yes it is positive that people sell after they bought. It's unhealthy to cling to a stock and message boards for 9 years.

    What is 1.000.000.000 shares? Just a measly pocket change. Some might argue that that is paid by stockholders, well that's just the idea how a stock-market works. It's a place where a company has access to capital.
    Some willingly provided the much needed cash for a start-up, so no whining needed from those. It has been in every quarterly the warning that the company is dependent on their ability to raise funds, mainly in the stock-market, if you can't get to grips with that, that's YOUR bad.

  82. Okay, now all 2014 newbies have experienced a GERS flag go up the pole and then burn, only to be put out with dilution. How mny times has that happened?

    However, this corn-pole has a different stroke with different folks. Why has GERS not gone international? At least until now.

    GERS has a strong relationship with Alfa Laval, a your-a-peeun company. Alfa is strong globally and wants to sell centrifuges globally. So what better way than to bring a new technology to a new market?

    I suggest the next filing will include reference to international sales. It may explain why there is suddenly a burst of new stock activity. Everything else is similar to what has been happening for years with GERS stock. A new market would bring fresh meat into the stock pool.

  111. It is a law of physics. Any up-tick in the PPS is met by a bolus of dilution shares that drives the PPS back to pre up-tick levels. Has happened every time; happened last week and will continue to happen until YAGI is out of the picture and that cannot happen until cash from the court award changes hands.

    Therefore, in the near future we will see a bolus of dilution shares fired into this little up-tick. Remember YAGI can hold up to 5% of an ever increasing number of common shares and fire them whenever they wish.
