Biased History, but a History Nonetheless

If you can get past the Prevost stuff that the judge has already rejected.  If you can get past the ridiculous statements about the poultry fat separator being the same thing as the corn oil extraction system.  (After they said that - they go on to describe the continuing inventive process ? ? ?) If you can get past the obvious (in my opinion) 2+2=5 stuff.  If you can get past all of that and more - starting about page 22 we have a lot of new information here for those interested in the history of this important invention, the process of discovery and how the inventors got 'er done.

  1. Disappointment reigns supreme. We were told last year that ending dilution this year was an important goal. This did not happen and the goal is no longer mentioned in the Q3. We heard from various sources that early last summer refinancing the debt was their top priority. This has not happened; there is another goal to do so in six months, and the hope that YAGI will not call the note in the meantime. We were told that by some pundits that great quarters for our clients would translate in into a "knock out" Q3 for GERS, that did not happen either (a loss was registered) and we now know for certain that we cannot translate licensee revenue into GERS' revenue -- further we have no idea why. We were told earlier this year that a new arrangement to limit legal costs had been secured and that only a modest $50,000 per month would be required. Now we read in the Q3: "We expect to continue incurring substantial costs in connection with our ongoing litigation for infringement of our patented corn oil extraction technologies. These costs increased during the second half of 2011 and are expected to continue to increase through 2012 in advance of trial, and as we expand our litigation to protect the competitive advantage of our licensees by prosecuting additional producers and other parties infringing our patents. These expenses may delay or otherwise adversely affect our ability to achieve our profitability and debt reduction goals."

    There are those that point to the successes in the litigation, yet those successes are marred by the extreme delay in the proceedings that are sucking the life out of the company and its common shareholders.

    There is one word that summarizes all these developments -- DISAPPOINTMENT.

  3. they dont have crystal balls, dumb ass. given the glut, the drought, the volatile commodity prices and other circumstances beyond their control, as correlated by the unexpected 1st, 2nd, and 3rd quarter results, i doubt they could have known how much they needed to borrow last spring, summer or fall, and will not know that number until near the end of the 4th quarter (christmas).

    I am surprised that in the year GERS promised to pay 1.6m in cash to YA, 3/4s of the way through it, they have not paid 1.2m to them. I expect the shortfall and residual to be made up this quarter, a promise is a promise. I fully expect Kevin to crank the printing press at least one more time to satisfy YA.

    I still think there will be another sub penny buy in oppertunity before the annual, there is plenty of time.
