So I took a look at what is on file at the Patent Office Portal. I saw all the normal filings. Items five, six and seven in the link below show the emails and correspondence that the defense seems to be clinging to at this point. Clearly these things were reviewed by the Patent Office. Clearly the Patent office has since approved the patent by issuing a NOA. This does not guarantee that a court or jury will agree in the long haul, however if does raise the bar for the defendants. The actions of the Patent Office are basically considered correct until proven otherwise.

Marquis Energy Update, Now Extracting 7 Million Gallons!
I found this update on Marquis Energy's website. Before Greenshift came along, Marquis was extracting about 1.7 MGY from their big plant. Greenshift was said to have more than doubled that. Then they bought another plant in Wisconsin.
The last I heard was the two plants combined were extracting 5.4 MGY. That old info is still on their site but so is this new update that claims 7 MGY. The name plate capacity of the plants are 100 and 50 MGY. The permitted capacity is 140 and 75 MGY. Depending on what they're actually producing, (maybe in the middle) I think it could be possible Marquis may be one of the customers GERS' likes to brag about that is doing .8 pounds per bushel.

Many of us have read the following:

But we need to look more closely. Unless you can cite specific language to the contrary this is as clear as mud to me. We think that we know that GERS is paying Winsness and others fees for patent utilization, but that may not mean that the patents do not come under YAGI's control if they call the loan at the end of the year. Throughout the filings the term "Company's patents" (as in ownership) is used to describe the patents. All Series D preferred shares have been pledged as collateral, and the owner of those shares controls the company. Also note that there is a definite distinction made between GERS and Cantrell Winsness Technologies, LLC (as not part of the "Company"). I think that unless we have documentation to the contrary, control of the patents may be in jeopardy if YAGI calls the loan and gains control of these extremely valuable patents. As we get closer to court certification of their primacy, their value increase further. From a business point of view it would be a great maneuver. Have GERS' common shareholders pay for the litigation costs, take over the patents just before court adjudication and capitalize greatly on their investment. If you were them you would do the same. By the way in this scenario we would likely be out in the cold and why obtaining new financing before the end of the year is so critical.
So, try and find documentation that the patents are not in jeopardy, I cannot, and the language in the filings imply they might be.

"The Valley’s only ethanol production plant is encouraging local farmers to plant grain sorghum next spring, promising to buy the grain to make ethanol instead of using Midwestern corn.
“We would love to buy all the sorghum they can produce,” said Lyle Schlyer, president of Calgren Renewable Fuels near Pixley in Tulare County.
Currently, the 55-million-gallon ethanol plant depends almost 100 percent on trainloads of corn shipped from the Midwest to make the biofuel.
Calgren has teamed up with the J.D. Heiskell grain company of Tulare and seed company Bill B. Vanola Grain & Seed of Stratford. Jeff Chedester, sales manager with Vanola, said 20 years ago there were tens of thousands of acres of sorghum grown in the Valley, but farmers converted mostly to corn. Today, Chedester estimates the region grows only about 5000 acres of grain sorghum.
“I don’t see any reason why we could not grow that crop to 25,000 acres plus,” said Chedester, who for the past month has talked up the idea with area growers with some success.
As a result of discussions earlier this year, several local growers planted some 1,100 new acres of the crop, Chedester said. Later this fall, that sorghum will be run through the Calgren plant with the theory being that no significant modifications will be needed in the facility to make ethanol.
“We’re pretty exited about it,” Schlyer said, adding that “we will do a test run through the plant this year” to make sure it processes as expected, likely from Chedester’s growers’ local crop. ”Our target would be to offset about 20 percent of the 20 million bushels of corn we need to bring in. If we did a lot more, we would have to figure out how to store it, but we are not putting a cap on it,” Schlyer said.
Sorghum is used to make biofuel in some states with a larger crop. Forty-three percent of the sorghum produced in Kansas and 23 percent of the sorghum produced in Texas is used to make ethanol, according to an industry source.
Chedester said benefits of producing sorghum include the fact that the grain will grow in high pH — salty — soil, uses a third of the water that corn requires, uses half the fertilizer and the seed costs about 20 percent of the current seed price for corn.
On the production side, farmers will get around three tons per acre for sorghum compared to five tons per acre for corn, “but with the lower input costs and lower water use, this really does pencil out,” Chedester said.
Josh Dejung of J.D. Heiskell says like with grain corn, the processing of sorghum at the ethanol plant puts out a distiller’s grain feed byproduct fed to cows — nutritious and cheaper than corn distiller’s grain that is an important part of ethanol plants’ margins. Dejung says he has been spending more time in Kern County talking to farmers now that his company has a grain facility near Bakersfield after they bought an old cotton gin.
Pixley is ideally located to take in grain from Kern, Kings and Tulare counties — within a 20-30 mile radius.
Schlyer said buying local helps save transportation costs for everyone since all California ethanol makers must pay to bring most of the feedstock in 100-car trainloads from the Midwest. Pacific Ethanol’s Paul Koehler said his company’s Stockton plant now uses about 11 percent locally grown corn. Lowering the transportation distance also makes the fuel produced greener as new state rules are phased in.
Using grain sorghum instead of corn should ease concerns of the California livestock and dairy industry — Calgren’s neighbors — who complain that using corn to make biofuel drives up the price of rolled corn they use to feed cattle. “This should help lower the price of corn,” said Chedester, who is part of a larger nationwide effort to increase sorghum planting for renewable uses.

...For years, National Sorghum Producers have advocated for increasing the use of grain sorghum, or milo, as an ethanol feedstock. Lately, the idea seems to be gaining steam. “There’s been increased interest over the past few months,” said John Duff, renewables program director for the United Sorghum Checkoff Program.
The first driver is drought, which has prompted some ethanol producers to search for alternate feedstocks, Duff said. While sorghum does have its limits, it’s more drought tolerant than corn, said Steve McNinch, CEO of Western Plains Energy LLC. “Corn is like a quarter horse, it will eventually run out of water and die. Grain sorghum is kind of like a donkey, it will wait for a while. You will eventually have to water it but it’s stubborn enough to wait. It’s a tropical plant so it likes the heat a lot better.”
Calgren Renewable Fuels LLC, a 58 MMgy corn-ethanol plant in Pixley, Calif., is considering adding sorghum to its feedstock mix as well as working toward building a digester. While the digester project stalled due to local opposition, the company is confident it will ultimately go forward, said President Lyle Schlyer.
The company’s investigation into sorghum is moving along at a faster pace. Calgren worked with area grain and seed companies, prompting area farmers to plant 1,100 new acres of sorghum, the fruits of which will be tested at the plant this fall. “Because it uses one-half to one-third the amount of water as corn and can be grown on alkaline soils that will not support a corn crop, we see sorghum as an attractive and viable crop for farmers in California’s San Joaquin Valley,” he told Ethanol Producer Magazine. “We anticipate running a modest amount of grain sorghum through our plant this fall and hope to dramatically increase the percentage of grain sorghum used as we go forward.”
The plant currently purchases less than 10 percent of its corn locally, a number Schlyer called “disappointingly low.” The good thing about adding sorghum is that company believes it will be able to do so without any modifications, although an additional enzyme to control foaming may be needed. Calgren was considering sorghum long before the drought but that certainly has highlighted the need to diversify feedstocks. “Our preliminary goal is to process 25 percent grain sorghum,” he said. “The ultimate percentage will depend upon commercial considerations, including how our distillers grain containing sorghum is received by our customers.”
According to a survey released in 2009, about 29 percent of sorghum produced in the U.S. is used for ethanol production. The USCP, which commissioned that study, is currently awaiting the results of a follow up study, expected in a few months, Duff said. The survey showed that the most sorghum was used for ethanol production in Kansas and Texas, where, on average, ethanol producers utilized 48 percent corn and 52 percent sorghum.
