The recent PR stated that "Critically, the '197 Application was allowed after the USPTO reviewed all of the relevant materials submitted by the defendants in GreenShift's current infringement litigation."
So I took a look at what is on file at the Patent Office Portal. I saw all the normal filings. Items five, six and seven in the link below show the emails and correspondence that the defense seems to be clinging to at this point. Clearly these things were reviewed by the Patent Office. Clearly the Patent office has since approved the patent by issuing a NOA. This does not guarantee that a court or jury will agree in the long haul, however if does raise the bar for the defendants. The actions of the Patent Office are basically considered correct until proven otherwise.

This has not been a real issue for months: GERS has documented, in several ways, the primacy of its technology and that the defendant's arguments about not infringing are vacuous. There is always the risk that judges and juries see things differently but GERS has done a great job of minimizing this risk.
ReplyDeleteThe real issue is how to translate this into an end game that GERS can survive long enough to execute. As the skirmish victories for GERS continue to mount, are the bad guys quietly executing their game plan? One which is not dependent on legalities, one often used by larger companies that covet smaller companies' technology -- delay them out of existence.
People you do recall that many millions of dollars are due a major lender by year's end; money they will not have unless another form of financing is found in a few months. Can the cloud of the litigation and its delays contribute to the reasons that new financing has not yet been found? It is getting late, and perhaps, just perhaps the defendants win by losing and GERS loses by winning.

Assuming that YAGI wants loan repayments when they could own the patents and all their obvious value simply by calling the loan is a wise business move on their part. They have let GERS fight all the battles to secure this intellectual property, with our money I might add, and then they can waltz in and take over, the about to be court certified, extremely valuable patents. I am not saying that this is going happen but to assume that what is in the best interest of GERS and its common shareholders is going to happen is wishful thinking. It is actually outlandish considering the leverage that YAGI has and the business potential the patents represents. Your absolute denial that such an outcome is even possible is clearly delusional. I am not sure that GERS could do anything to stop this and I believe that in this scenario the common shareholders would end up with zero. Please stop misleading the newbies that all is wine and roses here. This is one of the many reasons that the PE ratio is 0.125, why our PPS is 2 cents not $2+ dollars. Legal fees run both ways, the real ? with the recent patent decision and ending loan payment due by Gers is whether a settlement may occur. There are a lot of comments about hoe high risk GERS is, this is absolutely true and the share price reflects it, as unfortunately does the volume. My point here is a 10 to 20 bagger look like this and can be a full blown win or loss, if that is a playing field you can afford...it doesn't look like a bad play and the recent patent decision doesn't hurt.

ReplyDeleteI have openly admitted that I am taking a huge, almost foolish gamble on GERS. That to me is the "high" associated with this gambit along with pimping the cadets. The risk here is absolutely huge, but I am willing to look it square in the face, develop additional insights besides those of the disciples, even to where I have been accorded the courtesy of face-to-face meetings and a reasonable number of written communications. I haven't lost a cent and will not lose a cent, because I have "invested" only house money here -- when I hit it big on a similar gamble on GNBT more than six years ago during the avian flu panic.
We will need to catch some lightening in a bottle, get very lucky not to get wiped out, but if we do not, I will be very well off. SO I have it covered, I am enjoying the ride, playing with someone else's money and will be amazed and very happy if this makes a gazillionaire in the many years ahead. ReplyDeleteOver the years one of the sinequanon indicators of dilution was the trade of a large block of shares (usually but not always later in the day) with the PPS BELOW the BID at the time of the trade. These represented discounted shares and there was another block of shares that was traded inside the BID and ASK range that together accounted for the total discount. Of course, these shares could be not be identified as unusual in that they traded in the standard range. Over two quarters I found that I could estimate very accurately the total number of shares moved through dilution by multiplying those traded below the BID by 2.3 (that is 1.3 times the discounted shares were also in the dilution package). For reasons that will be clearer in the next several filings, that method over estimated the OS, basic and way under estimated the OS, fully diluted in the last filing. When we find out where those additional 50 million shares end up we will know the answer to this question. But, we haven't seen as much of the sinequanon trades in the recent past and this leads me to believe that currently dilution may not be as rampant as it has been.

They talk about corn oil and how yields are going higher. I think .75 pounds can be expected in the near future. I also believe the current price of corn oil is roughly $.44. I do expect it to be in the low $.50's by the end of the year.

ReplyDeleteHere's an excellent presentation from a possible GERS' customer, PEIX, that took place on 9-12.
It really is an excellent presentation. I encourage all to listen to it.
They talk about how the car companies are telling the ethanol companies that the new government standard of 54 MPG by 2020 is only possible with the high octane of ethanol. In other words, the new gasoline engines that will be coming out are similar to diesels in that they operate on high compression. I spoke about this in the past, Ricardo engines. They get more MPG of ethanol than gasoline. These smaller, high compression engines can't operate on the low octane of gasoline.
A lot of people are confused into thinking ethanol destroys MPG's, when in fact, it's the 90% subgrade gasoline that's partly to blame for the drop. Today's vehicles can't even operate on this subgrade form of gasoline without ethanol in it. Tomorrow's engines are being designed to take full advantage of the superior fuel, ethanol. Make no mistake about it, ethanol is a better fuel than gas.
It's no wonder people in "the know" are buying up more stock in ethanol, like the top investor of BIOF.
On slide 12, it states PEIX is in discussions with vendors to put corn oil technology in their other 3 plants. It's clear ICM was only awarded 1 contract for their smaller plant. In fact, ICM gave it to them and said pay us back(PR stunt). They're in discussions with other vendors(plural).
It's clear the door is still open for GERS. If ICM was awarded all the contracts, they wouldn't be in discussions with other vendors.
PEIX expects .50-.55 pounds per bushel from this ICM system. REX just reported .50 pounds, well below what Greenshift is doing and not even in the same ball park as 1.33.
It's interesting to note that method II will be ready by the end of the year. PEIX expects the other plants to have oil extraction technology by Q113.
