Adkins asks for an extension HERE with GreenShift's permission. I have said how important I think the '037 patent is to the overall outcome here. It will be interesting to start reading what the legal beagles think.

I usually understand these legal issues but my brain isn't working for some reason.

037 patent basically closes all the loopholes of the infringers. That's why the defendants tried to rush summary judgement to try and keep it out.

If the 037 patent has something clearly to do with the patents in the litigation, is there any reason why the judges wouldn't allow including it? Aside from corruption.
I mean, if the 037 patent is included, GERS will win. The 037 patent was approved and is directly related to the patents involved. I can't think of any reason why a judge wouldn't allow that (again, with the exception of corruption).
Does any one have any oppinions or know of any legal reason why they would not allow including it?
No especially since they wanted the 517 included.
Call me old fashioned, but the federal courts are not corrupt.

037 does nothing of the sort from what I have read. Seems to just add more time and money to this already crazy process. It's going to be another 5 years before this is resolved.

I've read every word of the 037 patent several times. I do believe it closes off the loopholes that the litigants keep arguing about.
If the 037 patent gets included, I don't see any way GERS could lose.
It just comes down to how long will we have to wait to get that patent added?
My take is that the 037 takes care of any loose ends, and sets the stage for a greenshift win.
