  1. So if this is over like all the scared ICM employees posting on this sight say it is, why would the judge even be concerned with this new ruling? I thought it was over? Appeal will be won, judge made a huge mistake in the SJ ruling. No biggie, happens all the time.

  2. Tomorrow is a VERY big day in GERSland. In fact, it may well represent a view to whether there is any hope left in GERSland.

    "The District Court has ordered the parties to show cause by November 6, 2014 as to why the Court should not unseal the entirety of the document for public access."

    IF the only issue that caused the judge to rule against GERS in the SJ is violation of the "no-sale bar", GERS should be jumping out of its skin to get that fact into public view. It appears that if the only issue is that perceived violation then we have some reasonable hope of succeeding with the appeal. IF, there are other issues and conditions/violations as well that are described by the judge, we really have no hope of an appeal overriding all of them. So, if GERS argues against release of the full ruling to the public in order to stave off complete collapse its PPS we will know our future -- none.

  4. In EZ Dock v. Schafer the Federal circuit addresses the application of the experimental use exception. It reversed summary judgment based on an invalidating public sale use. The court explained, " The Supreme Court expressly preserved the experimental use or sale negation. The Federal Circuit held that the new "ready for patenting" standard did not affect the experimental use doctrine. Thus, the Supreme Court and this court apply the experimental use negation without conflict with the "ready for patenting" prong of the new on-sale bar test.

  5. Hope that they do not drop the ball. GERS has until November 21, 2014 to file the appeal. If they do not the SJ stands.
