In support of their invalidity challenges under § 112, Defendants rely mostly on attorney argument and ignore the undisputed facts. Defendants allege that the Patents-in-Suit are invalid because (1) the term “substantially” is indefinite; (2) the heating step is not supported by the written description; and (3) mechanically processing a stream containing at least 15% or 30% moisture is not enabled. However, the undisputed facts clearly demonstrate that the Patents-in-Suit comply with each and every requirement of 35 U.S.C. § 112. Defendants have not raised any genuine issues of material fact and CleanTech’s motion for summary judgment under § 112 should be granted.

I am doing that (not at these levels, I will wait until 0.0003 or lower, which is where I added many tens of millions of shares last time). I believe that we will not see much positive here until this round of litigation is concluded, so our revenue will increase dramatically and we rid ourselves of YAGI. I am afraid that this is more than a few months away. This is my major source of contention with those that claim "riches are right around the coroner -- just wait until the next filing". Folks have been saying that for seven years, I have not. You judge whose perspective is more reasonable.

ReplyDeleteWe have had 67 trading days since we learned that the OS share count was 760,000,000. During those days we have averaged more than 15,000,000 shares traded per day. We have learned that NITE (the major, but not the only purveyor of dilution trades) accounted for an average 0f 49% of those trades. Assume, very conservatively that 30% of all trades were dilution based. Then 760,000,000 + 0.3 x 67 x 15,000,000 = 1,061,500,000 is an average, lower estimate of our OS count, basic as of today.
So what? Good for our company that they raise cash!

Why would you question the revenue increase when their existing and new customers are at record production levels. We get a piece of all that revenue. If one or more ethanol; producers settle, this moves rapidly higher. I think that there is a very good likely hood that that will happen. Big question is, will ICM indemnify all their clients who are infringing by association??? Ouch!
ReplyDeleteYou haven't been paying attention or you have not done your homework. Our client's revenues only marginally impact our reported revenue. It has been this way for several years. There is a good reason for this, one that will NOT be rectified until the current round of litigation is adjudicated. This is also why, in the face of client's record revenues, we must continue to dilute to pay our bills. PERIOD!!!
