Oh My!

ICM acknowledges that it specifically located, reviewed, and withheld certain documents from as early as 2004 regarding the infringing corn oil extraction process ICM later promoted to, and installed in, the ethanol plants of ICM’s customers.

ICM and Flottweg are both represented by the same counsel, however, and both failed to produce documents created before 2008. Furthermore, Plaintiffs have learned that ICM has agreed to indemnify Flottweg for this suit. See Ex. 4: Flottweg at pages 102-104.

Representatives of both ICM and Flottweg testified that these defendants made no effort to produce any documents created before 2008 and, in some cases, withheld documents created that year or earlier. 

Indeed, ICM actually withheld this information from Plaintiffs, and possibly from its own counsel.

  6. Fifty million shares is only $80,000 IF there were no discounts. That will not even pay for two months of legal services as contracted. The bills for the two new suits would come directly from this amount as well. In other words, 50 million shares MAY cover only one months legal expenses. GLTA

    sanctions have been filed in all types of cases and all types of courts.
    The sanctions imposed against parties in many cases are severe,
    including dismissals, adverse jury instructions, and significant
    monetary awards. Sanctions against counsel, although uncommon, are

    37(e) of the Federal Rules of Civil Procedure

It is time for all the little boys and girls, the genius that believed that there was going to be a pump and dump that they could capitalize on by buying a boat load at 0.002 to get out and cut their losses. Clearly not happening and their exodus will cause the price to fall sub 0.001 (that's triple zeroes to you weather forecasters).
