ReplyDeleteThe "deposition" would in fact "dispose" the defendants of this counsel. A quick search provides the insight that this strategy has been used for various aspects of consolidated cases (which ours is). The technical legal reasons for each I will leave to those more scholarly in jurisprudence.
ReplyDeleteThe only thing the "heat is on!" is the common shareholders and their ability to survive the furious slurry of dilution and the sucking vortex it creates for the PPS.

ReplyDeleteI am afraid that it is not quite that simple any longer. I am in for the gamble, but the last week looks as if they have taken the roulette ball and gone home. It may not fall for many years and we will just be watching as the wheel spins and spins into loss of equity and R/Ss. In other words, no 36 RED, no number at all.

ReplyDeleteBefore/after the trading day commences, there are much fewer participants entering bid and ask orders into the system for a security. It does not imply that there has been or will be a big change in the security's market value.
