ReplyDeleteLet's not forget, ICM told the infringers that under a proper interpretation of the patents claims, ICM's systems don't infringe. The judge interpreted them in GERS' favor and against what ICM led the infringers to believe. ICM has fired more than half of their work force since this lawsuit began. They're in way over their heads with the ability to indemnify the entire industry. This is likely the reason VLO has not continued the roll-out of the ICM POS to the rest of their plants. That and the fact it extracts 70% less oil in violation of GERS' patents. That's all that matters here.
ReplyDeleteThe judge has ruled against ICM's "prevost" and "95%" arguments. ICM's excuse for infringing has been debunked. In the end, patent infringing REX, VLO, and PEIX will license with GERS. The only question is, how many more millions will the infringers waste defending against lawsuit's they're clearly losing?
Those that say the defendants will soon capitulate because the cost of the litigation is too much and they are clearly losing have either forgotten or haven't accepted that their strategy is to drag out the proceedings as long as possible -- to wait for GERS to go under if you will. This is a very common and frequently successful strategy when the defendants have significantly more resources than the plaintiff. This creates many problems: 1) decreases the likelihood of alternative financing, 2) litigation costs increase the drain on revenue that mitigates against other sound business practices, 3) extends greatly the time to any money changing hands that could rescue GERS' financial condition, 4) expands dilution as a cash source, and 5) scares away other potential clients (any one hear of new signings for this great technology in the past year?). All of these factors and others places great pressure on the financial condition of GERS and does, whether you like it or not, place their continued existence in jeopardy. The market value of their stock screams this truth. Therefore, since the defendants seem to be winning this portion (NOT the the litigation portion) of the game who is to say if they are really wasting millions of dollars as some say -- until the fat lady sings.

ReplyDeleteNot only were their oil yields low, the money spent defending against GreenShift's solid family of patents drained what cash they had. Game Over. Legally licensed ANDE bought them and quickly made adjustments to the once infringing system, thus increasing their yields.
In reality, this is an example of how the "drag-it-out" strategy failed. The plant in Denison is now paying GERS' their deserved royalty.
We're also hearing from other infringers the pain the lawsuit is causing and the drain on precious cash reserves. Adkins comes to mind. They pleaded with the court about how much this was costing them. Other infringers are growing more worried ICM will not be able to keep their word leaving the infringing plants stuck with the liability.
There is no debate, infringing GERS' patents is a major distraction on management and a drain to profits. ICM has fired more than 50% of their hardest workers. The costs of infringing are devestating ICM. The treble damages owed are out of ICM's ability to pay. Summary judgement against ICM in the coming months will bankrupt them, IMO.
I would like the litigation to be expanded. With more infringers going bankrupt, those legally licensed with GERS may buy them out as we saw with ANDE.

A bankrupt ICM would leave numerous ethanol producers on the hook for what ICM promised to pay. Those burdened with this type of liability will likely be forced to sell out to the GPRE's, ANDE's, SXL's and MPC's of the world.
Time is on GERS side. Everyday the infringers continue to steal is more back royaltys adding up and higher costs payed to their worthless lawyers. We can clearly see the losses REX, PEIX, and VLO report, with REX having direct cash drains on earnings in relation to the lawsuit. These cash drains need to be applied to VLO, PEIX, and other infringers directly and as soon as possible. In the meantime, producers like ANDE and GPRE enjoy higher yields, higher profit, and no lawsuits draining resources.
Here's to a summary judgement against Adkins and to a bankrupt ICM.
