Infringement

Here are four combined documents GERS used to recently request Summary Judgment of Infringement against Lincolnway. Five documents total (one is hidden). In a massive filling of documents I count at least 16 total requests for summary judgment along with the supportive filings. I figure that covers all the defendants. I imagine they are all very similar - except for the redacted portions which describe each of the defendant's COES results.

  1. For this stock to do anything there needs to be volume, it's not getting it from patents or litigation motions...why?

    Debt clock?
    Litigation is going to drag on and they will get spent out?
    Market viability?

    They are no doubt a high risk, high reward stock but the latter "reward" needs volume and it's not there. I have a small play on this one considering more but can't get around the volume being so low? Any thoughtful discussion on this...

  2. Th folks that have kept the volume high for many years have either departed or are spent, others tire of the lack of transparency. Many newbies talk a good game but put no money on the table. Until either the litigation is resolved through settlements (final adjudication is off in the distant future), or new financing materializes real new money will be hard to come by and the volume will likely lag. The most critical is the financing, with a large note due at the end of this year that GERS cannot possibly fulfill, without the loan being renegotiated or a new "sugar daddy" found that will not drain shareholder equity. It is truly impossible at this time to value this as an investment for these and other reasons. Thus, this is a wild gamble now, that several of us chose to take, because the potential reward is now commensurate with the risk -- very high. However, until GERS becomes an investment it may be hard to attract the kind of interest necessary to move the PPS north consistently.

Cat got their pocket book? No one is buying BOZO. The good thing here is that most of the current class of cadets will pass on to other ventures soon, and perhaps the next class will be willing to engage in interesting repartee.

The fact that you are becoming almost orgasmic about $5800 in trades is your private affair. Do you have any idea at all what the trading will look-like when this finally takes off? I don't think so, $5800 will no even cover one of the hundreds of trades for that day.

  27. ADM Pioneered Front-End, GERS Pioneered Back-End

    ADM/Cargill

    I live 30 minutes from Cargill's plant in Blair. I've been there. It's a huge plant that sits on 600 acres. It's also a wet mill, just like their other plant's in Eddyville and Fort Dodge, Iowa.

    Roughly 80% of ADM's plants are wet mills as well. Food grade corn oil, the stuff at the grocery store, comes frome ADM and Cargill. This corn oil is extracted from the front-end by hexane gas extraction. It's expensive, not very profitable and is a process that's been around for a very long time.

    ADM actually pioneered this front-end process, just like GERS pioneered the process on the back-end.

    Despite any noise you may hear, somebody is barking up the wrong tree if they think ADM or Cargill infringe GERS' portfolio of patents.

    In fact, the opposite is true. Cargill is one of BIOF's largest shareholders, and as you know, BIOF is licensed with GERS.

    ADM does have some dry mill plants, but according to their website, they aren't extracting oil at this time. IMO, the door remains open for GERS in the 20% of ADM's plants that are dry mills, if/when they decide to do it.

    Any suggestion that GERS must take on ADM or Cargill is completely without merit, just like ICM's claims in court.

    I wonder why?

    So POET doesn't want to tell the world about how they were denied the patents that GERS' owns? I mean for a while there they released a steady stream of news bragging about the pending corn oil patent.

    They don't want to talk about it now or what?. Are they embarrassed, scared of getting sued?

    Is POET negotiating with Greenshift now? I'm not sure but while POET's application was getting denied, Greenshift was getting additional patents issued.

  29. Aemetis Ethanol COES In Keyes, California


    Is Aemetis licensed with Greenshift? They have a 55 MGY plant in Keyes, California that they just completed a COES in. Aemetis expects 2 MGY in corn oil. This amount of extraction fits GERS' claims of .8 pounds per bushel. Nobody else is getting these types of yields except GERS. I think there's a strong possibility here.

    I believe I have discovered some substantial news. I think I figured out what GERS was saying when they said they have interest in other systems and processes. I believe I know who it is.

    P.S. Hint: It's at an existing customer's plant. GERS has been trying to get biodiesel plants on site at ethanol plants for years. I think it's finally here!$!$!$!$!$

    POET's denial was not based on overlap with GERS; it was rejected because it's not novel. Ultimately I think this is bad for GERS as infringers could use the same logic PTO did.

  34. This just demonstrates the depths to which vendettas rear-back and hit the initiator in the face. The message that was deleted simply stated that we were going to contact Aemetis, Inc (AMTX) directly and inquire about whom they have licensed their COES, instead of continued pied piper speculations. This contact has been made and we will soon have the answer that will be shared on the sane blog.

    Incredible how vitriolic the disciples become when there is down day for their beloved GERS.

  37. The plant in Keyes is not a GERS plant. I know because I have seen the system they installed and it is a homegrown and designed system utilizing refurbished centrifuges.

  38. I have contacted the plant manager for confirmation as well. Thank you. This appears very similar to the situation several months ago when REX was proclaimed to be a likely licensee, which upon communication with the plant manager was determined to be incorrect. We must remain vigilant to the siren call of the pied pipers.

    Most disturbing, if true, is why are plants opting for sub optimal yields and technology when the importance of co-products is increasing? Is it marketing, is it the royalty which we now believe to be closer to 10%, is it the cost of installation? There must be good business reasons why these plants including PEIX have opted for a different direction.; there management are not idiots.

    I doubt that we can have an intelligent discussion here or on I-Hub about this important issue as it raises possibilities that are considered blasphemy.

  43. One note on sorghum- the oil does not yet have an RFS2 pathway approved so it can't be used for biodiesel. Shouldn't be controversial, but takes time to get done with EPA. Also, I've heard a wide range of estimates for oil yield- anything from a lot lower then corn to a little higher; so it's unknown if the sorghum plants will be a good play for GERS or not.
