10Q is out!

As of August 14, 2012, there were 38,761,157 shares of common stock outstanding.

Net income per share .16??? basic
Net income per share .05??? diluted

Revenues have increased during the three and six months ended June 30, 2012 as compared to the same periods last year. Revenues for the second quarter of 2012 increased to $4.2 million from $3.1 million generated during the three months ended June 30, 2011. Revenues for the six months ended June 30, 2012 were $7.2 million as compared to $5.9 million from the same period last year, . . .
We have entered into a modified contingency-based agreement with Cantor Colburn, LLP, our lead counsel in our infringement litigation, pursuant to which we are only required to pay $50,000 per month in cash. Accordingly, most of the increased legal costs incurred during the period were non-cash. Moving forward, we will continue to work with our licensees to maximize the benefits and minimize the costs of recovering as much corn oil as possible. We will also remain focused on winning new business and increasing our licensed penetration. To do so, we will continue to provide exceptional services, the highest-performing systems packages available, and access to new technologies for further gains in licensee profitability and competitive advantage. We will continue to expand our patent portfolio. We have many additional patents pending and we will remain committed to developing new technologies to further enhance the profitability of our licensees. And, we will stay the course in our ongoing infringement litigation but plan to expand our efforts to aggressively prosecute any entity, manager or other person infringing or inducing infringement of our technologies – all with a view towards enhancing and protecting the significant competitive advantage of our licensees.

Our financial performance for the balance of 2012 and beyond can be expected to be most significantly impacted by the rate at which our existing and new licensees commence production, the amount of corn oil that our licensees produce, the market price for that corn oil, the extent to which we collect reasonable royalties, and the costs incurred in our ongoing litigation for infringement of our patents. In addition, future results may be improved by the impact of event-driven systems integration contracts as we continue to receive significant interest for our engineering and other services in connection with the design, construction, integration and modification of corn oil extraction systems and other new systems for existing and prospective licensees. We are currently party to a number of such agreements which can be expected to contribute to revenue during 2012.

  3. My view is that today a White Opening Marubozu was formed. This shows that the day opened and then the prices continued to go up all day long without coming below the opening level thus forming a long white body, however prices did not close at the high of the day and thus they created an upper shadow. Oh, you can find that fortune teller under American Bulls.

    price is struggling against a benchmark volume day of 1,077,000 shares on 5/16/12....the low price of that bar is .02 high .0505.....so, that is the battle ground...we are in that price point with 66,000 shares...so, it looks a little light today to take out that price point...we likely will build cause (accumulation) for several days and then launch through that bars resistance price...

About 300,000 shares have been dumped so far today. It is unlikely that came from investors but it is possible considering the size of the trades.   69. techguess, it is similar data that I used to estimate the number of OS. I expected about 50 million and there were only 38 million. For the past two quarters the estimates were correct, which used a factor of 2.3 to translate the publicly available share count (based on trading profile)to that which was documented in the filing. This factor is about what you are seeing today. Do you think that the pace of dilution is going to pick up again? Also, there was no language about expecting additional dilution this quarter as there has been in previous filings. Significance?

Dilutive potential common shares include outstanding stock options, stock awards, and shared performance stock awards

    The weighted average common shares outstanding, basic reported May 15,2012 was 19,440,421. The weighted average common shares outstanding, diluted was the same. The weighted average common shares outstanding, basic reported this week was 28,447,748 and the weighted average common shares outstanding, diluted was 94,083,545. Any one else see the problem? The ratio of diluted to basic rose from 1.0 to 3.3. This relative difference (3.3 - 1.0) is identical to my previous translation factor of 2.3. Where did those shares come from?

  104. Looks like my algorithm was right on. I estimate the total number of shares being diluted by GERS by multiplying the trades that "look like" dilution by 2.3 and add this number to the total. This factor was derived from an empirical conversion calculation over two quarters; and it work well for the previous quarter. The reason it did not appear to work for Q2 was that the weighted average of shares (basic) did not include the entire spectrum of dilution as it did in the previous quarter (basic and diluted were identical). Now we find that (weighted average) OS(diluted) is 94,083,545 and the (weighted average) OS (basic) 28,447,748. The OS (diluted) is 2.3 time more than the OS (basic) or 3.3 fold.

  136. PEIX: Shopping Around With Other Vendors!$!$

    PEIX has agreed to install an ICM system in one of their smaller plants. They have not yet awarded contracts for the rest of their plants. In fact, it sounds like they're shopping around with other vendors now.

    "We're seeing in the industry that numbers are achieving 0.6, even a little bit higher than that. But a good conservative number to use is 0.5 pounds of oil per bushel(For the ICM system)."

    The ICM knock-off systems are only able to extract about .5 pounds per bushel. PEIX points out that the industry is doing .6 or better. Surely he's talking about BIOF .65 and GPRE .64 pounds per bushel.


    He goes on to say they're in talks with other vendors, which to me sounds like PEIX could be in talks with GERS after all...

    "In addition, we are currently in discussions with vendors to implement corn oil separation at our remaining 3 plants, which we expect to complete by the end of the first quarter of next year."

    Glacial Lakes 110 MGY plant in South Dakota will be online next month! Two more systems!

    "In addition, the company opted to pay for a corn
    oil separation project for the Mina plant from its operations. That project will begin later
    this year and will add a revenue stream through the sale of corn oil."

We were the first plant it went into; it was experimental at that point and it's worked out well. We have been considering the idea of adding a seperator for the production from the other half of the plant in Watertown, and also installing the technology at our plant in Mina, which is also about 110 million gallons per year."

    Your are certainly welcome; the more we attempt to decipher the less hazardous the landscape. But, I know very little about the accounting that goes on here or in any SEC filing.     How does POET feel about GERS installing systems in Glacial Lake's plants right in POET's home state of South Dakota?

    It's got to be embarrassing. I mean they're the largest producer in the world. They did so much bragging about their corn oil extraction system and the pending patent. Now they have the final rejection letter. I wonder why 'Ole POET never released a PR about their final rejection letter?

  150. So, if all I read is positive, why does the stock not gain pps? I suggest that until new financing is done and KK gives up his 51% ownership in the company, this will be the story. Even if GERS wins the court battle, KK and EC still own non-diluted 80% of the company. They may do what they wish with any settlement money, including giving themselves a big bonus and taking the company private leaving shareholders nothing.

    KK needs to give up controlling interest in the company. That is a fact for GERS to do anything on the positive side. However, he is in bed with EC and family here as well. The inventers are protected by contract. So pressure needs to be applied somehow on KK to make this a vesting adventure and not a money tree.

    These guys do not care a bit about the common shareholder. They are me, me, me people. So walk softly here.

  155. GERS can manage lowering investorship to below 200 just as they have been manipulating this stock since it was introduced. All they need to do is dilute until the stock is even more worthless and buy out investors.

    KK and EC are professionals at bilking investors. I heard from the very mouth that "I will be working to get the stock price up". Yea right, I read that as "get my income up". These guys are not even going to consider stockholders and they believe being a listed stock hampers their interests. Unless there is a big payout for them individually and not the shareholders, they will manipulate this stock to their interest. Look at their history with "skeleton stocks" that KK has manipulated and transferred in the past.

    Kind of like an "Osama BinBama" (obama) thing.

    The process is the same as corn ethanol. The oil is still extracted from the stillage. There's no down time, investment, or payback. Just throw it in with the corn. A Greenshift customer, Glacial Lakes just started doing it with great results. Glacial Lakes is using 10% milo.

    “We started looking at this about a year ago and we just recently had an
