ReplyDeleteJust read the entire document, GERS's lawyers nailed every possiblity of an argument that ICM and the defendants have.
My favorite part is how they show that not only do the patent-in-suit NOT limit the rate of substantially free of oil, but they point out several times that the ICM defendants completely avoid refference to the substantially oil stream; both required and used by all the defendants, and in clear infringment of the patents.
They also used a mathematical comparison that was awesome, they wrote:
"It would not matter if the percentage of oil actually present in the de-oiled syrup stream exiting the centrifuge is 1%, 5%, 20% or 50%.
The only thing that matters to the ICM Defendants is whether at least 95% of the oil in the concentrate is recovered in the oil stream. According to the ICM Defendants, a stream exiting the centrifuge that contains only 1% oil cannot be considered “substantially free of oil” if less than 95% of the originally present oil is recovered by the centrifuge."
BOOM- GERS is winning this one, no doubt.
