The discussion included the obvious statements that this could negatively impact shareholder equity if they were to lose. Mitigating this to some degree was the money put aside by ICM to indemnify the company as part of the agreement to license. The discussion went on to state that it wasn't known if this set aside would be adequate and that the company could be responsible for any difference required in court awarded damages.<br /><br />Now, use your head, if you were ICM would you enter into such an agreement without having an opt-out provision protecting ICM? Namely, it is logical that the agreement has language stating that in the event the licensee settles in an adverse litigation setting that ICM's indemnification commitment (umbrella) would no longer be in force. I have no insider information and I stated that this morning. Such an exercise has been witnessed in the futile attempts to discredit the calculations of GERS revenue from one small licensee. The data were derived from the average price received from GPRE GERS' largest customer. The upper range from literature in the trade journals. Ranges are extremely important when making estimates. Now, Slash who cannot be considered in any way negative to GERS has provided data documenting that the range I used was correct. (I now that wasn't his intention, but that is what he did -- Oops Slash).<br /><br />You ask why would they go through all this effort to discredit the unimpeachable? The upcoming 10K will show no where the projected revenue that these calculations impute based on all the licenses. This disconnect between licensee revenue has gone on for a while. An army has been raised to attempt to insure that this discrepancy and its lack of explanation is not known to potential new investors. The Player...Ok how many analytics are in the house?<br />The Players, Tech, Patents, Products, and Services are of the highest quality.<br />Since the deployment of the new business model of a revenue stream based on royalty's from licensing they have signed a healthy basket full of licensed partners, ethanol producers. These producers have installed systems to extract corn oil which operate within the scope of GreenShift's patents and chose to license with GreenShift. <br />Thus the new business plan for the most part looks to have been successfully initiated and put on the path of growth, it's innovative unsurpassable in performance tech has been awarded the highest quality of protection in the form of Patents awarded by the USPTO. Thus a consistent revenue stream has been created.<br />The company has lingering debt, yet they have business and revenue. My question is can the management team operate at a profit? Because only by operating at a profit can there be financial growth for shareholders, whether insider or outsider. When the value of the corporation and the common stock is estimated by the net worth of it's assets divided into it's shares of stock. Fundamental's are the rock solid base that should be secured first and foremost to begin the rise in growth of corporate value, thus the goal to operate the company at consistent quarterly to yearly profit. Thus to make good on the hopeful promises to investors of a gainful return on their investments. Sure the litigation is of utmost importance, but in the meantime and after it is still a business priority to operate at consistent profitability and to allocate those profits to further develop the business for even more profitability and increase in bottom line and growth in shareholder value. Thus returning the favor to shareholders for helping them get started by investing, by showing them gains on their investments. A successful full circle that when a business is operated at consistent profit should snowball.
